Jackson County, Georgia

Zoning, building permits and septic rules in Nicholson, Georgia

Nicholson, Georgia, in Jackson County, has its own zoning and requires a building permit from the city's building inspector before a building is erected, moved, enlarged or altered12. Septic permits are a separate office: Georgia requires a County Board of Health construction permit, so Jackson County Environmental Health is the one to call3. RVs may not be parked or stored on a vacant lot in the city4.

Does Nicholson, GA have zoning, and what does it mean for lot use?

Yes. The City of Nicholson adopts and enforces its own zoning ordinance for land inside city limits1. The city's use table lists six districts: AG, RR, SR, INST, TC and HB5. Which district a parcel sits in decides what you can put on it, so ask the City Clerk at Nicholson City Hall for the parcel's district before you make an offer10.

Rezonings go through the Nicholson Planning Commission, which holds public hearings and makes recommendations to the Mayor and Council11. Lot sizes, setbacks, lot coverage and building height sit in district tables that we could not confirm, so get them from the city before you design anything.

These are the city's rules. Land outside city limits falls under Jackson County's zoning for unincorporated areas instead12.

Do you need a building permit in Nicholson, and who issues it?

Yes. Inside Nicholson, the city's building inspector issues the building permit that must be in hand before buildings are erected, moved, enlarged or altered2. The inspector issues it only after the Zoning Administrator issues a development permit, where one is required2. A permit lapses if work does not start within 180 days or is suspended or abandoned for six months2.

Nicholson enforces the latest Georgia State Minimum Standard Codes as adopted and amended by the state Department of Community Affairs6. A final inspection is made once the building is complete and ready for occupancy13. A denial must be given to you in writing with reasons14.

This is the city's permit, not the county's: inside Nicholson, start at Nicholson City Hall, not at the Jackson County permit counter10. We could not confirm the city's permit fee schedule, so ask the City Clerk.

How do septic permits work inside Nicholson?

Septic permits do not come from the city. Georgia law requires a construction permit for any new onsite sewage system, and the County Board of Health must find the site suitable before issuing it3. In Jackson County that office is Jackson County Environmental Health in Jefferson, part of the Georgia Department of Public Health's Northeast Health District15. The County Board of Health also conducts the final inspection, and the system cannot be backfilled or used until it has written approval16.

We could not confirm a separate septic procedure in Nicholson's own code, so call Environmental Health before you buy a lot that is not on sewer. If public sewer is available within 200 feet of the property line, Georgia requires connection to it17. Across Jackson County, USDA rates about 69% of soils not limited for a conventional drain field, a strict rating, so a site evaluation is still the real test for any one lot18.

Can you live in an RV, tiny home or manufactured home in Nicholson?

RVs: Nicholson's code allows RVs on residential premises in the RR and SR districts only in side yards, rear yards, approved carports or enclosed buildings, and bars parking or storage on any vacant lot4. The code speaks to parking and storage and does not expressly address living in an RV, so ask the City Clerk before planning to live in one while you build4.

Manufactured homes: the city's use table permits them in AG and RR but not in SR, INST, TC or HB, and mobile homes are prohibited in all districts7. A manufactured home needs a permanent foundation, tie-downs and a roof pitch of at least 3:127.

Tiny homes: we found no tiny-home provision in Nicholson's code. Georgia treats a modular or site-built tiny home as a dwelling subject to the same building codes as any other home, and the local government decides whether it may be sited19.

Guest houses: one per lot, behind the main house, no larger than 50 percent of its floor area, and not rented separately8.

Building a home in Nicholson: the steps, in order

  1. Confirm the parcel's zoning district with Nicholson City Hall and whether your use is permitted there510.
  2. If the parcel is not on public sewer, contact Jackson County Environmental Health about a septic site evaluation and construction permit315.
  3. If the lot is being split off a larger parcel, check the subdivision rules: up to 3 mortgage lots may be created from a parcel of record in a three-year period without counting as a subdivision, and a mortgage lot needs a 30-foot access easement20.
  4. Get any required development permit from the Zoning Administrator2.
  5. Apply for the building permit from the city's building inspector2.
  6. Build to the Georgia State Minimum Standard Codes and pass the final inspection before occupancy613.

Georgia does not require a license to build your own home, but local codes, permits and inspections still apply21.

What stays with Jackson County, and what to check before you buy in Nicholson

Septic and wells stay with the county and state health offices, not the city322. The county's own building, zoning and RV rules apply to Jackson County land outside city limits, not to Nicholson lots: for example, the county requires a building permit in unincorporated areas and prohibits occupying an RV as a permanent residence there2324.

Check flood status: in special flood hazard areas without base flood data, Nicholson requires the lowest floor of new construction to be at least 3 feet above the highest adjacent grade25. If the lot fronts a state highway, a driveway needs a state permit from the GDOT district office26.

For taxes, Jackson County's effective property tax rate is about 0.9% and the median bill is $2,761 a year927.

Watch-outs

  • Nicholson's code addresses RV parking and storage but not living in an RV, so confirm with the City Clerk before treating an RV as housing4.
  • Inside Nicholson the city's rules apply, but outside city limits Jackson County's rules do; confirm which side of the line a parcel sits on12.
  • Short-term rentals in Nicholson need an annual license from the City Council, issued at its discretion, and a septic property needs a Jackson County Health Department evaluation28.
  • We could not confirm Nicholson's permit fees, lot dimensions, height limits or a city-specific septic procedure; ask the City Clerk or Jackson County Environmental Health1015.

Unanswered questions are usually a sign that Nicholson publishes no rule on the point, not that none exists. Jackson County’s page lists the county offices to call.
