Does Sky Valley, Georgia have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. Sky Valley adopts its own zoning with a Land Use District Map, and its districts are SF, MR, RC, CM and M27. Land inside city limits follows these rules, not Rabun County's.

In the Single-Family Residential (SF) district, density tops out at 1 unit per acre5. Minimum lot size is one-half acre outside the Mountain Protection Zone where sewer serves the lot, and 1 acre inside that zone or without sewer5. SF districts must be served by public water10. Single-family homes in SF must be at least 1,750 finished square feet and no taller than 40 feet611.

Accessory buildings sit in side or rear yards, at least 15 feet from any lot line12. RVs and travel trailers are not permitted for use or parking inside city limits, with narrow exceptions such as 48 hours of loading and unloading at a residence4. The city's code does not address tiny homes that we could confirm, so ask the building official before planning one; the 1,750 square foot SF minimum is the number to design around6.

Do you need a building permit in Sky Valley, and who issues it?

Yes. Anyone who constructs, alters, moves or demolishes a building, or changes its occupancy, inside Sky Valley must first apply to the city's building official and obtain a permit1. Separate permits cover concrete, mechanical/electrical/plumbing work, roofing, demolition and site walls over four feet1. Permits last six months and continue six months after each inspection1.

The City of Sky Valley Building & Tree Inspection department reviews building plans and site plans and inspects the work13. Applications are written, on forms the city furnishes14. Sky Valley enforces Georgia's mandatory state minimum codes with local amendments15. We could not find a published city fee schedule, so ask the department what your permit will cost.

Outside city limits, Rabun County runs its own building permits through the Rabun County page; county rules do not apply inside Sky Valley.

How do septic permits work inside Sky Valley?

The city does not issue septic permits. For new construction and major septic repairs, Sky Valley requires a separate septic system permit issued by the county health department, in addition to the city building permit163. Rabun County Environmental Health, part of District 2 Public Health, handles local onsite sewage services17.

Georgia rules say no one may begin physical development of a lot where a septic system will be used without first getting a construction permit from the county health department18. The permit follows a favorable site inspection, and a final inspection and written approval are required before backfilling or using the system19. Where a public or community sewer is within 200 feet of the property line, connection is required20.

Countywide, only about 3.3% of soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system21.

Can you live in an RV, tiny home or manufactured home in Sky Valley?

RVs: no. Sky Valley does not permit the use and parking of motor homes, recreational vehicles and travel trailers within city limits. Exceptions are storage entirely enclosed in a residence, garage or carport, and parking at a residence up to 48 hours for loading and unloading4.

Manufactured homes are permitted only in manufactured home parks8. Tiny homes: we could not confirm a city rule, so call the building department before buying. Georgia treats site-built or modular tiny homes as dwellings under the building codes, with local zoning controlling siting and minimum size22. In Sky Valley's SF district that minimum is 1,750 finished square feet6.

For land outside the city, Rabun County's rules differ; the county allows temporary RV lodging only in its Agriculture district, for up to 120 consecutive days23.

Building a home in Sky Valley: the steps, in order

  1. Confirm the lot's zoning district and whether sewer serves it, which sets a one-half or 1 acre minimum in SF5.
  2. Call Rabun County Environmental Health about a site evaluation and septic construction permit1716.
  3. Apply in writing to the city building official on the city's forms1413.
  4. Use a state-licensed contractor for residential contracting; a homeowner may pull their own plumbing, electrical, low voltage or HVAC trade permits9.
  5. Build to the Georgia state codes and complete each inspection within six months, or the permit lapses24.
  6. Get final septic approval from the health department before backfilling19.

We could not confirm a certificate-of-occupancy rule in the city code, so ask the building official how occupancy is signed off.

What stays with Rabun County, and what to check before you buy in Sky Valley

Septic permits stay with the Rabun County health department even inside city limits3. Land outside city limits falls under Rabun County's rules, which are different.

Before you buy, check these:

  • Flood zones. In A Zones without base flood elevation data, the lowest floor must be at least 3 feet above the highest adjacent grade, and encroachments within 20 feet of top of bank need engineer certification25.
  • Lot splits. No lot may be divided or reduced without a variance if it would break width, yard or area requirements26.
  • Short-term rentals. Nightly rentals are permitted in the SF, MR and RC districts27.
  • Water. SF districts must be served by public water10.

County-level figures: Rabun County's effective property tax rate is about 0.5%28, and 94% of the county is wooded29.

Watch-outs

  • RV living is prohibited inside Sky Valley city limits, so a plan that works on county land nearby may not work here4.
  • A city building permit does not cover septic; the county health department issues a separate septic permit16.
  • A building permit lapses if a required inspection is not completed within six months24.
  • We could not confirm city rules for building permit fees, driveway permits, private wells or accessory dwelling units; ask the Sky Valley building department at (706) 746-220413.
