Do you need a building permit in Woodford County, Illinois?

Unincorporated Woodford County requires a county zoning permit for covered construction and structures even though the county has adopted no building code.177 The zoning-permit fee for a dwelling with an attached private garage is $250 per dwelling unit; starting that structure without the required permit raises the fee to $1,000.18 Agricultural buildings and accessory buildings on an operating farm are exempt from zoning permit fees; that is a fee exemption, not a blanket exemption from county approval.1 A zoning permit expires if work does not begin within 90 days and generally expires after 2 calendar years without substantial completion.19 Illinois statewide baseline building-code requirements also apply in jurisdictions without a locally adopted code, but the state does not issue building permits for privately funded construction.2021 The county ordinance identifies a land-use-discontinuance inspection, with an agricultural-land exception; we could not confirm a general building-inspection or occupancy-sign-off requirement, so ask Building and Zoning about your project.222313

Who issues building permits in Woodford County, and how do you reach them?

The Woodford County Building and Zoning Department administers zoning, subdivision, floodplain, erosion, stormwater and rural-addressing matters in unincorporated Woodford County.13 Reach the department at 309-467-3023 or wczoning@woodfordcountyil.gov, or visit 115 N Main Street, Room 100, Eureka, IL 61530.13 The office issues zoning permits and handles plat approval, variances, special uses and rezoning requests.13 Inside Eureka and El Paso, the cities handle their own building permits.45 Private septic and well regulation for Woodford County addresses stays with the Woodford County Health Department.6 Contact the Health Department at 309-467-3064 or wchd@woodfordcountyil.gov, at 1831 S Main Street, Eureka, IL 61530.24

Does Woodford County have zoning?

Woodford County administers zoning in unincorporated areas, including variances, special uses and rezoning.25 Eureka, El Paso, Metamora, Germantown Hills and Washburn set their own municipal zoning.2627282930 The Woodford County Health Department remains the private septic and well office for addresses within Woodford County.31 The official map in the Zoning Administrator’s office is the final authority for a parcel’s current county zoning.32 Agriculture and Conservation districts have a 2-acre minimum lot size, subject to the special-use exception for Agriculture; R-1 lot size depends on private-sewage rules and Health Department review.33 In R-1, principal structures need a side setback of at least 10 feet or half the structure height, whichever is greater, and a rear setback of 30 feet.34 Road setbacks apply in every county district, while nonagricultural principal structures in Agriculture and Conservation need 30-foot side and 50-foot rear setbacks.3536 Final subdivision plats require County Board approval on the Plat Officer’s recommendation; municipal extraterritorial standards may also govern when higher.3738

How do septic permits work in Woodford County?

The Woodford County Health Department reviews plans and issues septic permits for new or renovated private sewage systems serving homes and facilities without public sewer.319 The septic permit costs $225, and permit fees are nonrefundable.39 Applications may take 2–7 working days because they are reviewed in the order received rather than while the applicant waits.40 The Health Department inspects new or repaired private septic systems; the published program does not establish a routine inspection interval for every existing system.4142 New, repaired, renovated or modified systems must be inspected before final approval, with at least 48 hours’ advance notice for the final inspection.43 Only about 5.7% of Woodford County soils are rated “not limited” for a conventional drain field; a site evaluation may identify a need for an engineered system, rather than rule out septic altogether.44 Newly constructed or renovated private wells also require Health Department permitting and inspection; the well-permit fee is $100.1045

Can you live in an RV or tiny home on your land in Woodford County?

Woodford County's R-1 rules expressly address only unoccupied recreational vehicles, so they do not establish permission to use an RV as a dwelling; ask Building and Zoning about the parcel and proposed duration before moving in.12 The county floodplain ordinance treats travel-trailer installation lasting more than 180 days per year as development that can require a floodplain permit.16 That floodplain threshold does not establish permission for residential RV occupancy elsewhere in Woodford County.1612 Woodford County does not separately define a tiny home, but any tiny home used as a dwelling in unincorporated territory needs a zoning permit and at least 800 square feet of habitable floor area per dwelling unit.4611 In the Agriculture District, a manufactured home must occupy at least 2 acres, be at least 24 feet wide and more than 35 feet long, sit on a permanent foundation, and meet the cited exterior and roof standards.47 Illinois lets a qualifying owner-occupant perform plumbing on a single-family residence, but that narrow rule is not a general exemption from county zoning permits or other construction requirements.1415

Building a home in Woodford County: the steps, in order

  1. Confirm that the parcel is in unincorporated Woodford County, then ask Building and Zoning to identify its zoning district and any municipal planning-area overlap.4849
  2. Discuss the house site with the Woodford County Health Department and obtain the private septic and well permits that apply.610
  3. Apply to Building and Zoning for the county zoning permit and any needed rural address, subdivision, variance, special-use, stormwater or floodplain review.5051
  4. If the site is in a regulated floodplain, obtain a development permit from the Zoning Administrator before starting development.52
  5. Confirm legal road access and the applicable roadway setback; every tract needs at least 20 feet of direct access, and a home in R-1 must abut a direct-access road.5354
  6. Arrange the Health Department's final septic inspection at least 48 hours in advance.43
  7. Ask Building and Zoning whether any project-specific building inspection or occupancy sign-off applies.2213

What should you check before buying land in Woodford County?

Start with septic feasibility: only about 5.7% of Woodford County soils are rated “not limited” for a conventional drain field, so obtain a site evaluation to determine feasibility and whether an engineered system is needed.44 For a proposed subdivision, ask whether municipal sewer is reasonably accessible; the subdivider must install a complete connection when the ordinance's access test is met and the municipality agrees.55 Verify the zoning district, minimum lot size, lot coverage and permitted use with Building and Zoning; R-1 lot size depends on private-sewage rules and Health Department review, and lot-coverage limits differ by district.565758 Check the applicable setback before locating improvements because county road setbacks vary by road jurisdiction and R-1 has additional side and rear yards.5960 Check flood maps before grading, filling, installing utilities or placing a structure.16 Typical farmland value is about $10,987 per acre, while the median annual property-tax bill is about $4,224 at an effective rate near 2.2%.616263

Watch-outs

  • Woodford County’s lack of an adopted county building code does not eliminate zoning-permit requirements for covered development in unincorporated areas or applicable Illinois baseline building-code requirements.120
  • R-1 rules address unoccupied recreational vehicles but do not confirm residential RV occupancy or temporary camping, so ask the Woodford County Building and Zoning Department before committing to those plans.12
  • A floodplain development permit can apply to construction, grading, filling, utilities and travel-trailer installation lasting more than 180 days per year.16

    • New development in a special flood hazard area must comply with the Woodford County Floodplain Ordinance and receive Zoning Administrator review and approval.
    • The ordinance defines a dwelling as a building or portion of a building used for residential purposes, including single-family and multi-family dwellings, but not temporary overnight accommodations; it does not expressly define or separately regulate 'tiny home'.
    • The zoning permit generally expires if work has not begun within 90 days; if work is not substantially completed within two calendar years, it expires, with an additional extension rule for commercial and industrial buildings. A replacement permit may not be valid beyond 365 consecutive days from issuance.
    • The fee table lists a $250 permit fee specifically for a dwelling with an attached private garage per dwelling unit, including two-family and multi-family dwellings; this fee should not be generalized to every tiny home. Fees were revised on December 16, 2025.
