Do you need a building permit in Blackford County, Indiana?

Yes. Blackford County requires an improvement-location permit before a structure is constructed, reconstructed, moved, enlarged or structurally altered, and its permit list includes homes, pole barns, garages, sheds, signs, porches, decks and roofs.1 Interior remodeling is exempt, while the ordinance separately exempts certain maintenance, yard work, essential services, small signs and low-value agricultural structures.1 The agricultural exemption applies only to a structure used exclusively for agricultural production and valued under $1,000, and it does not lift other zoning, building, health or septic requirements.10

Blackford County tells applicants which inspections their particular build requires, and inspections must be scheduled at least 24 hours ahead; prefabricated sheds are exempt from inspection.11 An occupancy permit is required before covered uses of vacant land or structures, including a new structure or a change in use, though routine work that does not change use, lot coverage or structure size is exempt.12 The statewide 2020 Indiana Residential Code applies to Class 2 and accessory structures, while other structure types may fall under other Indiana codes.13

Who issues building permits in Blackford County?

Blackford County Planning & Zoning handles improvement-location and building permitting at 110 West Washington Street in Hartford City; the office phone is 765-348-3884.14 Building, demolition, commercial wind and commercial solar applications can be filed through the county's online permitting portal.14

Start with Planning & Zoning before ordering plans or placing a structure. The county requires a scaled plot plan showing the property, structures, access, uses, utilities, drainage and septic information where applicable.15 A permit expires if work has not begun within 180 days, and a new permit is required if the project is not substantially complete within 2 years.15 Planning & Zoning identifies the inspections required for the particular build when issuing the permit.11 We could not confirm a general owner-builder exemption, so an owner doing the work should ask Planning & Zoning whether any additional contractor or inspection requirements apply.8

Does Blackford County have zoning?

Yes. Blackford County's zoning ordinance applies to all unincorporated land and to incorporated land in Hartford City, Montpelier and Shamrock Lakes.2 The county is divided into agricultural, residential, business, industrial and flood-related districts, and permissions vary by district.16

A dwelling must contain at least 720 square feet of occupied space, have an average width of at least 23 feet, and meet the ordinance's foundation or enclosure and residential-use conditions.3 Minimum lot area varies by district, and a lot without approved community sewer must contain at least 40,000 square feet or the larger area the sanitarian requires for an approved septic system.4 An accessory structure may serve as a dwelling only for elderly blood relatives of the family in the principal dwelling and must meet the cited ordinance provisions.17 Principal-structure setbacks run from 40 feet front and 20 feet side and rear in A-1 to 20 feet front and 8 feet side in R-3, and accessory structures must sit at least 5 feet from side and rear lines.18 Base height limits outside the named exempt districts are 35 feet for principal structures and 20 feet for accessory buildings unless the Board of Zoning Appeals approves otherwise.19

How do septic permits work in Blackford County?

The Blackford County Health Department administers on-site sewage through its local health officer and environmental health specialist.6 A Blackford County development without community sanitary sewer service must include evidence that the County Board of Health issued a septic permit.7 The health department page lists a $100 septic permit fee and a $75 annual septic installer license fee.20 The Environmental Division provides the septic-system permit application and can be reached at (765) 348-4317.21

Treat soil suitability as an early feasibility question: only about 0.2% of mapped county soils avoid a “very limited” rating for a conventional septic drain field.22 That rating does not decide an individual parcel, but it makes professional soil evaluation especially important before fixing a house site. Existing residential septic systems must be inspected under county policy, with particular attention to systems built before 1985 when property is offered for public sale.23 Indiana generally requires a compliant septic tank and soil-absorption system where a dwelling cannot connect to sewer; drywells and cesspools are not allowed.24

Can you live in an RV or tiny home in Blackford County?

Blackford County limits occupancy of a recreational vehicle outside an approved RV park to no longer than four weeks.5 An approved RV park is subject to separate location and development rules, so the exception does not authorize permanent RV residence on an ordinary parcel.25 Ask Planning & Zoning how the occupancy permit and sanitation rules apply before staying in an RV during construction.127

Blackford County does not separately classify tiny-home occupancy in the available rule summary, but any tiny home used as a dwelling must meet the county's dwelling definition: at least 720 square feet of occupied space, at least 23 feet in average width, and the stated foundation or enclosure conditions.3 Homes require improvement-location permitting, and occupied structures or changed land uses can require an occupancy permit.112 A site without community sewer also needs evidence that the County Board of Health issued a septic permit.7

Building a home in Blackford County: what are the steps?

  1. Ask Blackford County Planning & Zoning to confirm the parcel's district, residential use, minimum lot area, dimensions and floodplain status.164
  1. If community sewer is unavailable, contact the County Health Department and obtain septic-permit evidence for the application.26
  1. Prepare the scaled plot plan showing property, structures, access, uses, utilities, drainage and septic information where applicable, then submit the permit application.1514
  1. Confirm that the plans meet the statewide residential code and the county's dwelling standards.133
  1. Obtain road-access permission from the government with jurisdiction; INDOT handles state-highway access through its electronic permit system.27
  1. Complete the inspections assigned to the build and obtain the occupancy permit before covered occupancy or use.1112

What should you check before buying land in Blackford County?

Confirm zoning, legal access, septic feasibility, water, flood exposure and division history before closing. Blackford County regulates subdivisions, and an approved, recorded secondary plat is required before subdivision lots may be sold, permits issued or buildings erected.28 A subdivision generally gets only one vehicle-access point onto a major collector or arterial road, although the Commission may allow more when needed for safety and circulation.29 For access onto a state highway, INDOT permission is required; access on another road belongs to the government with jurisdiction over that road.27

In the county's floodway and floodplain districts, special exceptions require a state Natural Resources permit, and floodway-fringe buildings generally need a flood protection grade at least 2 feet above the regulatory flood profile.30 Floodway development usually falls under Indiana DNR jurisdiction, while local floodplain rules can still govern fringe development.3132 We could not confirm a standalone Blackford County private-well permit requirement, so ask the County Health Department before arranging drilling.9 For carrying-cost context, the county's effective property-tax rate is about 0.8%, with a median annual property-tax bill of $779.3334

Watch-outs

  • Nearly all mapped soils carry severe limits for a conventional drain field, so make septic feasibility a purchase contingency rather than assuming a standard system will work.22
  • Blackford County zoning reaches unincorporated land and the incorporated jurisdictions named in the ordinance, so a rural parcel still needs district-level review.2
  • A permit can lapse if work does not begin within 180 days or is not substantially complete within 2 years.15
  • Occupying an RV outside an approved RV park is limited to four weeks, so an RV is not an open-ended housing option while building.5
  • A dwelling must have at least 720 square feet of occupied space and a 23-foot average width, which can rule out many tiny-home designs.3
