Do you need a building permit in Geary County, Kansas?

The confirmed Geary County building-permit rule is narrower than a blanket requirement for every rural project. For construction associated with a proposed subdivision, the subdivision must be approved and recorded, or the lot must have been lawfully created under the subdivision regulations, and required infrastructure must be completed or guaranteed before a building permit may be granted2. On an unplatted tract, any required on-site wastewater system permit and any required on-site water well permit must already be in hand before the relevant permit issues1112. The subdivision rules also bar building, onsite-wastewater, occupancy and similar permits on land that has not been prepared and approved as required13. Ask Building & Code whether a project outside that setting requires a building permit and what plans and inspections apply3. Development in the regulated floodplain requires its own floodplain development permit9.

Who handles Geary County building permits, and how do you reach them?

Geary County Building & Code / GIS-Zoning Enforcement is the first contact for a project-specific building-permit answer; call 785-530-5399 or email gis@gearycounty.org3. Planning & Zoning accepts applications for zone changes, special-use permits, county conditional-use permits, site or development plans, plats and vacations, with required documents and the appropriate fee14. The one published fee we could confirm is $100 for a county conditional-use permit, submitted to the Zoning Administrator with the required documents; fees for building permits and other approvals were not confirmed, so request the schedule before filing15. The GIS / Zoning office can be reached at 785-530-6093 and provides an online planning application16. For flood-area construction, contact the Floodplain Administrator because that approval is separate from ordinary building and zoning review917.

Does Geary County have zoning?

Yes. Unincorporated Geary County publishes Agriculture, Suburban Residential and Single-family Residential districts, with floodplain-related districts addressed separately1819. Uses, density and bulk standards vary by district, so lot size, setbacks, lot coverage and height must be checked for the parcel rather than assumed from a countywide number12021. Kansas generally exempts land and buildings used only for agriculture from local zoning, but dwellings and garages are not agricultural buildings, floodplain rules remain applicable, and road setbacks may still regulate agricultural buildings22. A division of AG-zoned land into parcels of at least 40 acres may avoid subdivision review only when no new street is created and the access, frontage, drainage and other stated conditions are satisfied23.

How do septic permits work in Geary County?

Geary County allows private individual sewage-treatment systems on subdivision lots where sanitary sewer installation is not required, but the systems must follow the Geary County Sanitation Code6. Subdivisions inside an established sewer-system or sewer-district service area must connect with approval from the responsible utility24. Where a septic system is needed on an unplatted parcel, its permit must be obtained before the building permit issues, and the same holds for a required water well permit1112. Kansas allows local governments to approve plans and issue construction or operating permits, so call the county Sanitarian at 785-530-5126 before selecting or installing a system2526. Only about 4.6% of Geary County soils are rated without severe limitations for a conventional drain field, making soil and site evaluation an early purchase task27. The application steps, fees and inspection schedule for septic permits could not be confirmed; ask the Sanitarian directly26.

Can you live in an RV or tiny home on your land in Geary County?

An RV may be occupied for living, sleeping or housekeeping in unincorporated Geary County only in an RV park or as a permitted temporary dwelling on a lot with a valid building permit for a home under construction4. In suburban-residential and single-family-residential districts, permanent RV parking must also avoid the front yard, a required yard along a public street and the area within 10 feet of a side or rear lot line28. A manufactured home used as a single-family residence on an individual lot is a conditional use7. In the AG district, a manufactured home may serve as an accessory dwelling for people employed on the agricultural land and their families, but the home or land cannot be intended or used as a rental29. A separate tiny-home rule, minimum dwelling size and general temporary-camping rule could not be confirmed; ask GIS / Zoning how the unit will be classified16.

Building a home in Geary County: the steps, in order

  1. Ask GIS / Zoning to confirm the parcel's district, allowed residential use and applicable bulk standards516.
  2. Confirm that the parcel was lawfully created; Geary County regulates subdivision outside incorporated cities, and an unplatted tract must have proper frontage and public-road access3031.
  3. Ask the Sanitarian to determine whether sewer connection or a private system applies before fixing the homesite, and obtain any required septic and well permits before the building permit32111226.
  4. Ask Building & Code whether the project needs a building permit; subdivision-related permits depend on plat compliance and completed or guaranteed infrastructure23.
  5. Obtain a separate floodplain permit if the site is in a regulated flood area9.
  6. Obtain a state permit before constructing driveway access onto a Kansas highway33.

What should you check before buying land in Geary County?

Start with legal access, water and wastewater. An unplatted parcel must have proper frontage and satisfactory access to a public road, and additional right-of-way may be required31. A subdivision developer must arrange water service or prove an adequate onsite supply; an onsite well must have enough quantity and quality for the proposed development intensity34. Only about 4.6% of county soils are rated without severe limitations for a conventional drain field, so evaluate the site early27. Check flood status with the county for land outside Junction City, Grandview Plaza and Milford17. Farmland value averages about $2,862 per acre, while the effective property-tax rate is about 1.5% and the median annual property-tax bill is about $2,537353637.

Watch-outs

  • The confirmed building-permit rule concerns subdivision-related construction; ask Building & Code directly about a project outside that setting23.
  • RV occupancy is limited to an RV park or a permitted temporary dwelling tied to a valid building permit for a home under construction4.
  • A manufactured home on an individual lot is a conditional use, while the agricultural accessory-dwelling allowance is limited to workers and their families and cannot be used as a rental729.
  • Septic permits, well permits and the floodplain development permit are each separate approvals from the building permit, and the county sets the order: required septic and well permits come first on an unplatted tract11129.
