Building permits, zoning and septic rules in Cecil County, Maryland

47Index Score / 100
#15 of 24 in Maryland

Cecil County, Maryland requires a building permit for most construction, including a new home, an addition or an accessory structure, everywhere in the county except the towns of Elkton and Rising Sun, which run their own entire permitting process12. The county's Permits & Inspections Division enforces the 2021 International Codes and reviews applications alongside Planning & Zoning and the Water & Sewer Planning Division before issuing a permit34. Zoning in unincorporated Cecil County comes from the county's Planning & Zoning Division, while each incorporated town zones its own land56. On-site septic is handled by the county's own Water & Sewer Planning Division, not a separate health department, in the towns as well as outside them78.

Wells
A well construction permit is required statewide for any well, submitted by a licensed driller14
Permit timeline
A permit expires one year after issuance, and work must start within 180 days of issuance15

Do you need a building permit in Cecil County, Maryland?

Yes, in most of Cecil County: the Permits & Inspections Division requires a building permit for residential, commercial, agricultural, demolition, accessory-structure, pool, manufactured-home and change-of-use projects, and work cannot begin until the permit is approved and issued1. Cecil County enforces the 2021 International Building, Residential, Energy Conservation, Plumbing, Mechanical and Swimming Pool and Spa Codes as of June 3, 2024, plus the 2023 National Electrical Code as of August 2, 20253. Two towns, Elkton and Rising Sun, handle their entire permitting process themselves rather than through the county, so a buyer there should start with the town hall instead2. Six more towns, Cecilton, Chesapeake City, Charlestown, North East, Perryville and Port Deposit, require that town's approval before the county will accept a building permit application2. A $10 non-refundable technology processing fee applies at application, with the building permit fee itself due before issuance, and an approved permit expires one year after issuance with work required to start within 180 days115.

Who is the Cecil County building department and how do you reach them?

The Cecil County Permits & Inspections Division, at 200 Chesapeake Blvd in Elkton, issues building, electrical, plumbing and demolition permits and can be reached at 410-996-52354. Applications go through the county's OpenGov online permitting system, and the office asks that work not start until the approved permit is in hand4. Inspections, including footers, foundation, framing and insulation, require 24-hour advance notice, and a project cannot proceed past each stage without that inspection's approval16. A Certificate of Use and/or Occupancy is required before a building can be used, and it isn't issued until building, plumbing, HVAC, electrical, zoning, and Water & Sewer Planning approvals are all complete17.

Does Cecil County have zoning?

Cecil County has countywide zoning, administered by the Planning & Zoning Division at 410-996-5220, which reviews subdivision plats and ensures development conforms to the Cecil County Zoning Ordinance918. The county's zoning districts include NAR, SAR, RR, MH, LDR and more than a dozen others, each with its own table of permitted, conditional and special-exception uses19. Residential zoning districts generally cap building height at 35 feet, with side and rear yards required to grow for anything taller, though agricultural and agribusiness structures are exempt from that height limit outside the Chesapeake Bay Critical Area or an airport approach zone20. The county ordinance applies in unincorporated Cecil County only; the eight incorporated towns keep separate zoning, so a lot inside town limits follows the town's rules216. The minimum lot for a detached single-family home is 20,000 square feet in the NAR, SAR, RR and LDR districts where community water and sewer are not available, and 12,000 square feet where they are22. A double-wide manufactured home is allowed as a principal dwelling in the NAR, SAR, RR, LDR, ST, VR and UR districts if it is at least 40 feet by 24 feet and sits on a continuous permanent masonry foundation23. A minimum dwelling size and a tiny-home occupancy rule were not confirmed in the county zoning ordinance, so a buyer planning a small home should call Planning & Zoning rather than assume either way18.

How do septic permits work in Cecil County?

Cecil County's own Water & Sewer Planning Division, not a separate health department, administers Maryland's standards for on-site sewage disposal systems countywide, including in the incorporated towns724. Statewide, a permit from the local Approving Authority is required before constructing an on-site sewage disposal system, that permit is valid for no more than two years, and no part of the system may be covered or used until it's inspected and approved2526. Soils are a real limiting factor here: USDA soil survey data rates only 8.6% of Cecil County's soils as free of severe limits for a conventional septic drain field, so expect a site evaluation early and budget for the possibility of an engineered or alternative system on much of the county's land27. Before you count on septic at all, check whether the parcel sits in a county sewer service area: where public sewer is available, county policy requires connecting to it, and an undeveloped lot shown in the county's sewer maps must connect as a condition of the building permit13. Where a conventional system will not work, Maryland lets the local Approving Authority and the Maryland Department of the Environment approve an alternative system on an existing lot, and both must approve the site before design begins28. A portable toilet cannot support a new building, and it may be used no longer than 3 days within a 60-day period without Approving Authority authorization29.

Can you live in an RV or tiny home on your land in Cecil County?

Not simply by parking one: Cecil County's zoning ordinance allows a travel trailer to be used as a temporary residence only in the NAR, SAR and MH zoning districts, and only when it sits inside a legally existing campground that has itself received a special exception12. A campground or RV park itself needs a special exception in the NAR, SAR or MH zones, and a camper may stay no longer than 100 consecutive days or 150 total days in a calendar year30. A travel trailer owned by the occupant of an existing dwelling on the property may be stored there, but the ordinance treats that storage as distinct from living in it as a residence12. Cecil County's zoning ordinance also does not contain a specific tiny-home occupancy provision, so that use is unconfirmed rather than settled either way; call the Planning & Zoning Division before you buy with either an RV or a tiny home in mind18.

Building a home in Cecil County: the steps, in order

  1. Confirm your parcel's zoning district and whether the property is in one of Cecil County's incorporated towns by calling Planning & Zoning at 410-996-5220182.
  2. If the property is in Cecilton, Chesapeake City, Charlestown, North East, Perryville or Port Deposit, get that town's approval before applying to the county; if it's in Elkton or Rising Sun, apply through the town instead2.
  3. Submit your building permit application through the county's OpenGov portal, paying the $10 technology processing fee, and confirm whether the lot must connect to public sewer or can use septic113.
  4. If using septic, get the Water & Sewer Planning Division's on-site sewage disposal permit before construction begins2425.
  5. If you need a driveway entrance onto a county road, get a permit from the Director before building within the county right-of-way31.
  6. If drilling a well, get a well construction permit through the county's Approving Authority before drilling14.
  7. Schedule required inspections, including footers, foundation, framing and insulation, with 24 hours' notice at each stage16.
  8. Get your Certificate of Use and/or Occupancy once building, plumbing, HVAC, electrical, zoning and Water & Sewer Planning approvals are all complete, before moving in17.

What to check before you buy land in Cecil County

Cecil County's land is gentle and largely wooded: 93% sits at 15% slope or less, and about 43.3% is forested, with federal land making up just 1.6% of the county323334. The nearest city of 100,000 or more people is about 40 miles away35. Before you close, ask whether the parcel is inside a county sewer service area, since a mandatory hookup can run around $12,000 in fees even if the lot has a working septic system13. Cecil County's zoning ordinance allows one accessory apartment per existing single-family home in the NAR, SAR, RR, LDR, ST, UR, VR and MH districts, for an immediate family member only, with the owner living on the premises and a minimum floor area of 300 square feet36. Maryland also required every county to adopt a local law authorizing accessory dwelling units by October 1, 2026, so ask Planning & Zoning whether Cecil County's new rules have replaced that family-only limit3718. Budget for property taxes too: the effective rate runs about 1%, with a median bill near $3,059 a year, against a typical home value around $389,795 and farmland running about $10,443 an acre38394041.

Watch-outs

  • Maryland's accessory dwelling unit law set an October 1, 2026 deadline for Cecil County to adopt its own authorizing local law; confirm with Planning & Zoning what is now in effect before counting on an ADU3718.
  • A lot in a Cecil County sewer service area can be required to connect to public sewer, at a Major Facility Fee around $12,000, even where septic would otherwise work13.
  • Only 8.6% of Cecil County's soils are rated free of severe limits for a conventional septic drain field, so get a site evaluation before you finalize plans on a parcel that will rely on septic27.
  • Chesapeake City adopted a new zoning ordinance on September 15, 2026, so a lot there follows the town's new code, not the county's42.
