Does Lake Winnebago, MO have zoning, and what does it mean for lot size and setbacks?

Yes. Lake Winnebago adopted its own zoning code, Chapter 400 of the city's Unified Development Ordinance2. The city says that apart from acreage zoned agricultural, the rest of Lake Winnebago is zoned R-1 residential1. Districts A, R-1, R-3, B-1 and PD are published in the code6.

In R-1, a non-lake-front lot needs at least 12,500 square feet and a lake-front lot at least 7,500 square feet, with a minimum width of 75 feet4. R-1 setbacks are 30 feet in front, 30 feet at the rear and 7.5 feet on the side, rising to 30 feet on a corner lot's side7. Buildings can cover at most 35% of an R-1 lot8, and residential structures are limited to 2 stories, with a third story allowed only on the downhill side of a natural slope9.

In the A Agricultural district, lots need at least 3 acres and 200 feet of width, and general agriculture needs 10 acres10. A district setbacks are 50 feet in front and 30 feet at the rear11.

How big does a house have to be in Lake Winnebago?

R-1 sets a minimum living area by house type: 1,700 square feet for a single-story home, 2,050 square feet for a one-and-one-half story home and 2,400 square feet for a two-story home5. Porches, patios and garages do not count toward those totals5. These minimums are far above what unincorporated Cass County asks, so a plan that works on county land may not fit inside Lake Winnebago.

Do you need a building permit in Lake Winnebago, and who issues it?

Lake Winnebago City Hall issues building permits inside city limits. Remodeling that involves structural, plumbing, electrical or mechanical work requires a building permit1. New homes follow the same process, but the plans must first go through architectural review by the Lake Winnebago Home Owners Association Architectural Review Committee1. The city has adopted the 2018 International Residential Code, amended1.

The city's sample fee sheet for a new home lists $400 for plan review and permitting, $4,000 for a water service connection, $4,000 for a sewer service connection and $600 for a street impact connection1. Contact1 for the current application and the inspection fee for your home size.

How do septic permits work inside Lake Winnebago?

We could not confirm who permits septic systems for a lot inside Lake Winnebago city limits, or whether a new home must connect to city sewer. The city's new-home fee sheet lists a sewer service connection fee1, which suggests city sewer service, but the city should confirm it for your lot.

The Cass County septic ordinance covers only unincorporated land, and its permit and inspection rules do not establish county authority inside a municipality3. Ask Lake Winnebago City Hall first, and the Cass County Building Codes, Zoning & Environmental Health Department second12. Missouri requires a construction permit before installing or repairing most onsite wastewater systems, with some single-family lots exempt13.

Can you live in an RV or tiny home in Lake Winnebago?

We could not confirm whether Lake Winnebago allows RV living, temporary camping, tiny homes or manufactured homes on a residential lot. Those uses are governed by the use table in the city's zoning code, which we did not review2. Because R-1 sets a minimum living area of 1,700 square feet for a single-story dwelling, a small dwelling is unlikely to qualify as a primary home5. Call Lake Winnebago City Hall before you buy a lot on the assumption that an RV or tiny home is allowed1.

Building a home in Lake Winnebago: the steps, in order

  1. Confirm the lot's zoning district, minimum lot size and setbacks with City Hall1.
  2. Submit your plans to the Home Owners Association Architectural Review Committee for architectural review1.
  3. Apply for the building permit at City Hall, which lists plan review and permitting among its fees1.
  4. Ask City Hall about sewer, water and septic for your lot before you pay connection fees1.
  5. Build to the city's adopted codes, including the 2018 International Residential Code as amended1.

What stays with Cass County, and what to check before you buy?

Cass County's rules for building permits, zoning and septic apply to unincorporated Cass County, not to land inside Lake Winnebago14. Cass County's septic ordinance, for example, is limited to unincorporated areas3. Confirm that your parcel lies inside city limits before relying on either set of rules.

For a driveway onto a state highway, Missouri requires a MoDOT right-of-way permit15. Check the flood hazard map for your lot, because development in a Missouri floodplain needs a permit16. Cass County's effective property tax rate is 0.9%17.

Unanswered questions are usually a sign that Lake Winnebago publishes no rule on the point, not that none exists. Cass County’s page lists the county offices to call.
