Christian County, Missouri

Zoning, building permits and septic rules in Nixa, Missouri

The City of Nixa, Missouri adopts its own zoning in Chapter 117 of its code1 and issues its own building permits2. Septic is mostly a non-issue inside city limits: where public sewer is available, new buildings must connect to it3. For land outside city limits, Christian County's rules apply instead.

Does Nixa, Missouri have zoning?

Yes. The City of Nixa administers its own zoning in Chapter 117 of its code of ordinances, and it applies to land inside Nixa city limits1. Christian County's separate zoning regulations cover only unincorporated land8.

Nixa's districts include R-1 single-family residential and AG, along with R-3, R-4, R-5, office, commercial, and industrial districts9. Dimensions depend on the district. In R-1, lots need at least 6,600 square feet and 60 feet of width4. In AG, lots need at least 20,000 square feet and 100 feet of width5. Buildings in both R-1 and AG are limited to 35 feet67. Buildings on a residential lot may cover no more than 40 percent of it10.

These figures come from the most recent amendment we could review, so check them against the current code4. Ask Nixa Planning & Development which district a parcel is in before you buy; the city keeps the zoning map.

Do you need a building permit in Nixa, and who issues it?

Inside Nixa city limits, the City of Nixa's Planning & Development Department issues building permits. The city states that "most construction projects will require a building permit"2. Construction in the city must follow the 2018 International Building Codes and the 2017 National Electric Codes2.

Applications go through the city's MyNixa portal or on paper forms2. Anyone building in the city also needs a contractor's license; the application fee is $50, with a $25 annual renewal2. Call (417) 725-5850 or email planning@nixa.com2.

We could not confirm whether Nixa has an owner-builder exemption for a homeowner building their own house, or what Nixa charges for a residential building permit. Ask the city office before you plan a self-build.

How do septic permits work inside Nixa?

In most of Nixa the answer is that they don't. Where public sanitary sewer is available, the city's code requires new buildings to connect to it and prohibits private sewer disposal systems3. Sewer counts as available when it is within 400 feet of the property line with adequate capacity3. The city has also considered allowing temporary private systems west of Gregg Road, but we could not confirm that rule was adopted3.

Where a lot has no sewer, septic permits come from the Christian County Health Department, which has run a county-wide onsite wastewater ordinance since 199211. Missouri also requires a construction permit before installing or repairing most onsite wastewater systems, though some single-family residential lots may be exempt12.

Before you buy, ask Nixa Planning & Development whether a specific lot is within reach of a sewer main.

Can you live in an RV or tiny home in Nixa?

We could not confirm Nixa's rules on living in a recreational vehicle, camping on private land, or occupying a tiny home. The city's zoning chapter has a use table for each district that would answer this, and Planning & Development can tell you what applies to a specific parcel2.

Do not assume Christian County's rules carry over. The county's RV and manufactured-home rules apply to unincorporated land, not to land inside Nixa city limits13.

Two related rules are confirmed. A primary residence with an accessory apartment is allowed only on a lot at least 150 percent of the district's minimum lot size14. Nixa also has manufactured-home districts, R-MHS and R-MHC9; we could not confirm which uses each district allows.

What are the steps to build a home in Nixa, Missouri?

  1. Ask Nixa Planning & Development which zoning district the lot is in and what the lot-size, setback, and height limits are2.
  2. Confirm whether public sewer is within reach, since sewer connection is required where it is available3.
  3. If the land is being divided, check Chapter 115 of the city code, which governs subdivisions inside the city15.
  4. Hire a contractor who holds a Nixa contractor's license2.
  5. Apply for the building permit through the MyNixa portal or on a paper form2.
  6. Schedule inspections as work proceeds, using the city's online scheduling form or its inspection hotline2.

If no sewer is available, add the Christian County Health Department to the list before you hire a contractor11.

What stays with Christian County, and what should you check before buying near Nixa?

Land outside Nixa city limits follows Christian County's rules. Unincorporated Christian County requires a building permit for construction16 and has its own zoning17. Nixa's rules do not apply there, and the county's do not apply inside the city.

Wells are a state matter: Missouri requires a non-restricted water well installation permit to construct or repair a water well18. We could not confirm separate rules on private wells inside Nixa city limits.

Christian County's effective property tax rate is 0.8%19. Only 13.7% of Christian County soils are rated not limited for a conventional septic drain field, so a lot without sewer may need a site evaluation or an engineered system20.

Watch-outs

  • We could not confirm how Nixa handles driveway permits, short-term rentals, agricultural exemptions, or building permit fees, so ask Nixa Planning & Development at (417) 725-58502.
  • Nixa's lot-size, setback, and height figures come from a 2021 amendment to Chapter 117, so confirm them against the current code before relying on them4.
  • A building in a mapped flood hazard area can need a floodplain development permit in addition to anything the city requires; ask Nixa Planning & Development whether a parcel is mapped21.
