Building permits, zoning and land rules in Athens County, Ohio

63Index Score / 100
#23 of 88 in Ohio

Unincorporated Athens County, Ohio has no adopted county zoning, but floodplain development permits and subdivision approval for property splits still come from the county1. Septic permits come from the Athens City-County Health Department4, and zoning inside the City of Athens and other municipalities is set by those places5.

Do you need a building permit in Athens County, Ohio?

Athens County does not administer a general county building code, except for requirements on new or substantially improved buildings in floodplains2. Any development in an Athens County floodplain needs a county permit7; covered work includes houses, manufactured homes, substantial alterations, accessory buildings, grading and fill19. Ohio's statewide codes still govern covered construction, including detached one-, two- and three-family homes under the Residential Code20. Required plans go to the certified municipal, township or county department with jurisdiction; nonresidential plans go to the state when no certified local department covers them21. If no certified residential department has jurisdiction, the owner does not need the residential-code submissions, inspections or occupancy certificate, but floodplain, septic and subdivision requirements remain16. Confirm the serving department for the parcel and building type before work begins.

Who issues building permits in Athens County, and how do you reach them?

Athens County does not publish one building department for every project; certified departments may cover residential work, nonresidential work or both22. For an unincorporated parcel, start with the Athens County Regional Planner, which handles county floodplain permits and subdivision review23. Inside the City of Athens and other municipalities, the city issues zoning permits, while septic permits for any Athens County address still go through the Athens City-County Health Department5424. Ask which certified building department serves the address and building type before submitting plans. Where a residential building official has jurisdiction, a new home cannot be occupied until a certificate of occupancy is issued25. The exception for areas without a certified residential department is jurisdictional, not a blanket owner-builder exemption, and we could not confirm the department serving every Athens County parcel16. A qualifying agricultural building may receive a state building-law exemption, but floodplain, subdivision, septic, fire or utility requirements may remain26.

Does Athens County have zoning?

Athens County has no adopted county zoning, but that does not mean every parcel is unzoned8. The City of Athens administers zoning and publishes a zoning map, while other municipalities require their own review275. Athens Township zones the bounded The Plains area rather than the whole township9. On existing unincorporated parcels outside local zoning, Athens County sets no zoning-based minimum dwelling size, lot-coverage limit or building-height limit282930. New subdivision lots are different: county tables set minimum lot dimensions and setbacks according to development, roads, utilities and terrain3132. Before treating an RV, tiny home or manufactured home as allowed, identify the municipality or township and determine whether the parcel is an existing lot or a proposed split.

How do septic permits work in Athens County, Ohio?

The Athens City-County Health Department administers sewage-system permits in Athens County10. A new or replacement system needs a soil and site evaluation, qualified design, application, floor plan, plat map, operation-permit form and fee; installation must be performed by a registered installer33. Ohio requires installation or alteration approval and a valid operation permit, while Athens County issues five-year operation permits for systems installed or altered since 20151134. The department inspects enrolled systems at renewal but may accept a service provider's formal inspection12. Sewage from a dwelling must go to an approved treatment system or sanitary sewer35. Only 3% of county soils are rated free of severe limits for a conventional drain field, so establish septic feasibility before buying36.

Can you live in an RV or tiny home on your land in Athens County?

Unincorporated Athens County has no county zoning restriction on RV occupancy or temporary camping on a specific parcel1314. That answers only the county-zoning question: township, municipal, sewage, health, floodplain and state rules may still control the setup14. Tiny homes, accessory dwellings and manufactured homes likewise face no county zoning restriction on unincorporated land, but building-code, installation, sewage and floodplain requirements can still apply153738. A manufactured home regulated by Ohio's installation rules generally cannot be occupied until it receives an inspection seal39. Before placing any unit, ask the Regional Planner whether floodplain or subdivision rules apply, identify any municipal or township zoning, and ask the Health Department how sewage will be handled.

Building a home in Athens County: the steps, in order

  1. Locate the parcel in its municipality or township because zoning and building jurisdiction vary locally40.
  1. Ask the Athens County Regional Planner whether the site is in a flood hazard area and whether a proposed split needs subdivision approval234142.
  1. Confirm which certified building department covers the building type; required plans must be approved before covered work begins unless the residential no-certified-department exception applies2116.
  1. Complete the soil evaluation, sewage design and permit process with the Athens City-County Health Department before installation33.
  1. Identify who controls the road. New or replacement access onto a county road requires an access or culvert permit and final inspection; other roads have different authorities43.
  1. Complete required inspections and obtain the applicable occupancy approval before using the home4425.

What should you check before buying land in Athens County?

Check sewage feasibility first because only 3% of Athens County soils are rated free of severe limitations for a conventional drain field36. The Athens County Water and Sewer District serves The Plains and the US 50 Sanitary Sewer Project area, but service depends on the parcel45. Within the sewer district, accessible existing buildings must connect after official notice; a county-water connection requires capacity and meter fees4647. Review flood mapping because floodplain development needs county approval, with separate residential and commercial permit fees4148. For a proposed split, verify subdivision approval, setbacks and final-plat access before closing173249. Terrain can add cost because 30.7% of county land has a slope of 15% or less and 78.2% is wooded5051.

Watch-outs

  • Athens County's lack of county zoning does not settle building-code jurisdiction; the owner-builder exception applies only where no certified residential department has jurisdiction16.
  • Athens Township zoning covers only the bounded The Plains area, while municipal zoning must be checked separately95.
  • A floodplain permit becomes void if work does not begin within 180 days and remains valid for one year from issuance52.
  • A short-term rental operating as lodging must register with the Athens County Auditor within 30 days of starting business, but registration does not establish that local land-use rules allow the rental53.
