Do you need a building permit in Dewey County, Oklahoma?

No. Unincorporated Dewey County has no county building-code program and does not require a county residential building permit1. Oklahoma gives county commissioners building-code and permit power only in counties with more than 500,000 people, and Dewey County's population is 4,2861213. State law also exempts a single-family dwelling, duplex, barn, shed, or attached carport in an unincorporated area from the State Fire Marshal building permit214. The exemption does not waive building codes, septic authorization, floodplain requirements, subdivision rules or other approvals2. Oklahoma's adopted construction codes remain the statewide minimum, and the 2024 editions took effect September 14, 202615. Other building types may need a State Fire Marshal building permit where no local authority requires one, and every State-Fire-Marshal-permitted project must be inspected1617. We could not confirm which authority handles every other project in unincorporated Dewey County; ask the county courthouse before construction18.

Who issues building permits in Dewey County, Oklahoma?

Dewey County has no identified county building or zoning office because it has no county building-code program or countywide zoning ordinance13. For a subdivision plat or county-road access question, call the Dewey County Board of County Commissioners or County Clerk's office through the state-published courthouse number, (580) 328-56681920. Inside Seiling, the town directs applicants to municipal building-permit and zoning rules; Oklahoma DEQ still issues septic authorizations by property location45. Oklahoma's State Fire Marshal has statewide jurisdiction unless a county or town has completed an authority-having-jurisdiction agreement, but the responsible authority for every other Dewey County project could not be confirmed18. Projects subject to State Fire Marshal building review use the OKSFM Accela Citizen Portal; email and paper submissions are not accepted21. Stormwater, driveway and floodplain approvals are covered below.

Does Dewey County have zoning?

No. Dewey County has no documented countywide zoning ordinance or planning commission3. Oklahoma gives county commissioners zoning power only in counties with more than 500,000 people, and Dewey County's population is 4,2862213. Without a county zoning ordinance, unincorporated Dewey County sets no minimum home size, minimum lot size, setbacks or building-height limit9. RVs, tiny homes, manufactured homes, accessory dwellings and temporary camping are likewise unrestricted under county zoning rules9. Town rules are separate: Seiling directs applicants to its municipal code for zoning regulations and building permits, while septic authorization remains with Oklahoma DEQ45. The City of Dewey has municipal zoning, but that city is not in Dewey County and its ordinance does not govern land here23. Usual farm buildings used for agricultural purposes are also outside county zoning authority, although other requirements can still apply24.

How do septic permits work in Dewey County?

Oklahoma DEQ runs the on-site sewage program statewide, and before installing a new system or modifying an existing one in Dewey County, you must purchase an Authorization to Construct from DEQ5. DEQ assigns the authorization to the local Environmental Specialist by property location, and DEQ must review the Report for On-Site Sewage before issuing it5. The completed system must be inspected and approved by DEQ or installed, self-inspected and approved by a certified installer before use25. Since November 1, 2025, a person without DEQ certification may install only one on-site sewage system per calendar year5. Only 9.2% of Dewey County soils are rated without severe limitations for a conventional drain field, so arrange the site evaluation before committing to a house location26. If a standard design will not work, DEQ must approve an alternative system before installation27.

Do you need stormwater, driveway or floodplain permits in Dewey County?

Several approvals sit outside the courthouse even with no county building permit. Construction that disturbs one acre or more, or smaller work inside a larger common plan of development over one acre, needs DEQ's OKR10 construction-stormwater permit, with a $100 application fee plus a $347.71 annual fee for new sites28. The process starts with a Notice of Intent: identify the site entrance latitude and longitude and the receiving water body, prepare a Stormwater Pollution Prevention Plan, and submit the notice with site maps and fees online or by mail; processing takes about 14 days from receipt, and any city or county permit coverage should be checked first29. A driveway onto a state highway needs an approved ODOT application, including a signed, notarized Driveway Agreement and site plan, before any work in the right-of-way; runoff may not reach the highway, and drainage pipe ends must be 4:1 or flatter30. We could not confirm a county-road driveway permit rule, so ask the commissioners19. For floodplain development on private land, any permit comes from the local jurisdiction; contact the local floodplain administrator before building, because the state water board regulates only state-owned or state-operated property31.

Can you live in an RV or tiny home on your land in Dewey County?

Unincorporated Dewey County has no zoning ordinance restricting how you occupy your own land, so county zoning does not limit RV or tiny-home living or set a minimum home size or lot size9. Septic authorization still comes from Oklahoma DEQ, and a town may apply its own zoning and building-permit rules54. A manufactured home is treated differently when occupied: Oklahoma deems an occupied manufactured home a permanent installation, and a new manufactured home must follow federal installation standards or a manufacturer-approved plan32. Oklahoma's health lodging chapter does not regulate rental of an entire house and grounds, but that does not settle municipal zoning, fire, tax, septic or other requirements for a short-term rental3334. We could not confirm a Dewey County certificate-of-occupancy process for an ordinary home35.

Building a home in Dewey County: the steps, in order

  1. Ask the county courthouse whether the parcel is unincorporated and which authority handles the building project; the statewide authority rules do not identify the responsible office for every Dewey County site1918. If the property is in Seiling, check the town's building-permit and zoning rules4.
  1. Check water and septic feasibility, then purchase DEQ's Authorization to Construct before installing or modifying a septic system365.
  1. If creating a residential development outside a town, obtain DEQ plat approval before recording, selling lots or building; a plat with a lot under 2.5 acres needs DEQ's approval stamp3710.
  1. Take a public-road subdivision plat to the Board of County Commissioners before filing it with the County Clerk3819.
  1. For a state-highway driveway, get ODOT's approved application before right-of-way work; ask the commissioners about county-road access3019.
  1. If the work disturbs one acre or more, file DEQ's OKR10 Notice of Intent; if the site is in a mapped flood hazard area, ask the local floodplain administrator about a development permit2931.
  1. Build to Oklahoma's minimum construction codes even though an ordinary home in unincorporated Dewey County needs no county residential building permit139.

What to check before you buy land in Dewey County

Water and soils are the headline concerns: annual precipitation is about 28.5 inches, severe drought occurs in 36.9% of years, and only 9.2% of soils are rated without severe limitations for a conventional septic drain field404126. A domestic well used for a household, qualifying livestock, or irrigation of less than 3 acres does not need an OWRB intent-to-drill authorization; a contractor drilling a non-domestic well must obtain OWRB approval first4243. Confirm legal access: ODOT approval is required before work within state-highway right-of-way, and a mapped flood hazard area adds a local floodplain permit question4431. The effective property-tax rate is about 0.6%, and the median annual bill is about $7134546.

Watch-outs

  • The State Fire Marshal building-permit exemption for listed structures does not establish a Dewey County certificate-of-occupancy process, so ask the county courthouse what closeout documentation applies235.
  • An owner working on a qualifying roof may be exempt from roofing-contractor registration, but owner-occupied, sale-or-rental and code conditions limit the exemption6.
  • Even with no county zoning or building permit, statewide minimum codes for electrical, mechanical, plumbing and fuel-gas work still apply, enforced by the Construction Industries Board15.
