Which Oklahoma counties don't require a building permit?

Oklahoma has 53 counties where residential building permits are not required for unincorporated land, 17 with requirements limited to particular cases, and 7 where residential building permits are required.189 County counts apply outside city limits; cities set their own building-permit and zoning rules.16 Start with Pushmataha County, Atoka County, Latimer County, McCurtain County, Pittsburg County, Hughes County, Johnston County, Pontotoc County, which do not require residential building permits for unincorporated land.1

Oklahoma statewide minimum building codes still apply, including electrical, mechanical, plumbing and fuel-gas enforcement by the Construction Industries Board in unincorporated areas.2 The State Fire Marshal permit exemption covers single-family homes, duplexes, barns, sheds and carports attached to those homes in unincorporated areas; local requirements can still apply.1718 Use the Oklahoma counties without building permits list to narrow a search, then ask the county building authority about the proposed structure and parcel.1

Which Oklahoma counties have no zoning?

Oklahoma has 49 counties without countywide zoning and 10 counties with zoning; zoning in the remaining counties is unconfirmed.31011 The highest-scoring counties without countywide zoning begin with Adair County, Pushmataha County, Atoka County, Latimer County, McCurtain County, Pittsburg County, Hughes County, Johnston County.3

Oklahoma has 41 counties combining no residential building-permit requirement with no countywide zoning.12 Compare the no-zoning list and the no-building-permit-and-no-zoning list when selecting rural land.312 No countywide zoning does not remove statewide septic construction approval or local floodplain regulation in participating communities.519 Oklahoma exempts usual agricultural farm buildings from the zoning power conferred by the cited planning act, but that exemption does not waive other environmental, health or safety requirements.20

Who issues septic permits in Oklahoma?

Oklahoma Department of Environmental Quality administers on-site sewage treatment, with state-agency septic authority across all 77 counties.421 Before installing a new septic system or modifying an existing system, obtain a purchased and issued DEQ Authorization to Construct; DEQ must review the Report for On-Site Sewage before issuance.5

The property’s report determines allowable system types and minimum dispersal requirements, using residence size, lot size and shape, and soil-test results.22 Alternative systems need DEQ approval before installation, and new installations or modifications need inspection and approval before operation, through DEQ or certified-installer self-inspection.22 Call DEQ Environmental Complaints & Local Services about soil testing, system design and installation oversight; ask for the current Authorization to Construct charge before budgeting.23 A county’s lack of residential building permits does not replace DEQ septic approval.15

Can you live in an RV or tiny home on your land in Oklahoma?

Oklahoma has county-level RV occupancy answers for 46 counties: 44 allow living in an RV on your own land and 2 have limited allowances; answers for 31 counties remain unconfirmed.6 Unincorporated Adair County, Pushmataha County, Atoka County, Latimer County have allowing answers based on the absence of a county zoning restriction; those answers do not waive sewage-treatment or other applicable requirements.65

Oklahoma has tiny-home occupancy answers for 46 counties, all allowing occupancy, while 31 counties remain unconfirmed.7 Unincorporated Adair County, Pushmataha County, Atoka County, Latimer County are among the counties with allowing answers.7 Compare the RV-living counties and tiny-home counties before choosing a parcel.67 We could not confirm a general statewide RV or tiny-home occupancy rule; ask the county planning office, or the municipal planning office inside city limits, about the proposed use.67

Where are the best Oklahoma counties for a bolthole?

Adair County and Pushmataha County lead Oklahoma’s Bolthole Index scores at 81 out of 100, but Adair has limited building-permit requirements while Pushmataha has no residential building-permit requirement; both have no countywide zoning and state septic authority.24 Atoka County scores 80, Latimer County 79 and McCurtain County 78; all have no residential building-permit requirement, no countywide zoning and state septic authority.24

Oklahoma’s median county farmland value is $2,515 per acre, with Beaver County at $1,100 and Harper County at $1,147 per acre in the farmland-value figures.25 Treat those agricultural values as comparison context when reviewing asking prices. Oklahoma’s median county effective property-tax rate is 0.6%, and its median county property-tax bill is $813 annually.26

What should you check about Oklahoma water, wells and access?

Oklahoma exempts qualifying domestic groundwater use from water-use permits and domestic wells from intent-to-drill authorization, including household use, livestock within the land’s grazing capacity and irrigation of less than 3 acres.15 Non-domestic wells require OWRB drilling authorization tied to an active groundwater-use permit; examples include commercial use and irrigation exceeding 3 acres.27 For irrigation of exactly 3 acres, ask OWRB Water Permitting to confirm the applicable category before drilling.152728

Johnston County, Pontotoc County, Murray County, Carter County include land in the actively managed Arbuckle-Simpson Sensitive Sole Source Groundwater Basin.29 Ask OWRB about the intended water use and location rather than assuming a domestic exemption covers a commercial project.1527 Before doing driveway work in state-highway right-of-way, obtain an approved Oklahoma Department of Transportation Driveway Agreement; submit the agreement and a sketch or site plan.30

Watch-outs

  • City building-permit and zoning requirements can differ from the unincorporated county answers; confirm the parcel’s jurisdiction with the municipal or county building authority.16
  • No residential building permit does not remove statewide minimum codes, DEQ septic approval or local floodplain requirements in participating communities.2519
  • Oklahoma owner-builder electrical and residence plumbing exemptions address state licensing, while local building permits and inspections may still apply; ask the issuing building authority before starting work.1314
  • Residential-development plats outside municipal limits need Department approval before recording, offering lots for sale or beginning construction; the 2.5-acre plat rule is not a universal minimum lot size for every parcel.3132
  • County requirements can change through lawful adoption of codes or zoning; ask the county building and planning authorities to confirm current requirements before buying.3334
