Do you need a building permit in McClain County, Oklahoma?

McClain County publishes permit processes for floodplain development in unincorporated areas, new or modified drives connecting to county roads, and road crossings2. The available county materials do not establish a general residential building-permit process, so ask the Floodplain Administrator about the parcel and project rather than treating silence as an exemption920. Oklahoma does not require a State Fire Marshal permit for a single-family home, duplex, barn, shed or attached carport in an unincorporated county area, but that state exemption does not cancel applicable local requirements21. A county floodplain development permit is required where the county floodplain program applies22. Inside incorporated places, building permits come from the municipality instead: Blanchard has adopted the international building codes and conducts building permits and inspections7. The county's floodplain, road and DEQ septic requirements still apply to land in or near a city6. For Newcastle and Purcell we could not confirm who issues building permits, so ask the city office before relying on the county answer45.

Who handles floodplain and road permits in McClain County?

For development covered by the county floodplain program, use the McClain County Floodplain Administrator; the application requires the development's latitude and longitude2320. A new or modified drive attaching to a county road uses the county's Road Connection Application2. A road crossing requires a completed, signed and notarized application, a detailed work-area map, a certificate of insurance and a $1,000 check per permit made payable to the McClain County Board of Commissioners; the Board of Commissioners considers the application after the materials are verified2425. A driveway connecting to a state highway instead requires an Oklahoma DOT Driveway Agreement, and work in the right-of-way cannot begin until the approved agreement is returned26.

Does McClain County have zoning?

Unincorporated McClain County has no county zoning1. As a result, county zoning sets no minimum dwelling size, minimum lot size, setback, lot-coverage limit or building-height cap there2713282930. Municipal rules vary: Blanchard, Newcastle and Purcell have their own zoning, as does Washington, while Byars does not, so confirm whether the parcel lies inside a city or town before relying on the unincorporated-area answer3456. Usual farm buildings used for agricultural purposes and the planning of crops are outside Oklahoma county zoning authority, but that exemption does not answer floodplain, septic, access or subdivision requirements16. The statute behind county zoning powers adds forestry activities to that exemption, though the research did not establish that McClain County administers zoning under it17. Residential developments outside city or town limits remain subject to state plat review even though McClain County lacks zoning14.

How do septic permits work in McClain County?

Septic permits in McClain County come from Oklahoma DEQ, not the county or a city; DEQ's Environmental Complaints & Local Services division handles soil tests, system designs, installation inspections and oversight of certified installers through local environmental specialists1131. Before a new system is installed or an existing system is modified, DEQ must issue an Authorization to Construct8. The published application lists a $357.28 DEQ-augered soil test, a $214.36 soil test when the applicant supplies pits, and a $285.80 plan-review fee for an alternative system32. Only 28% of McClain County soils are rated without severe limits for a conventional drain field, so settle the septic design before choosing a house site33. Every new or modified system must be inspected and approved by DEQ, or installed, self-inspected and approved by a certified installer, before it is placed into operation34. A non-certified person may install only one on-site system per calendar year beginning November 1, 202532.

Can you live in an RV or tiny home on your land in McClain County?

County zoning does not restrict RV occupancy, tiny-home occupancy, manufactured-home occupancy or temporary camping on land in unincorporated McClain County12. That answer is limited to county zoning: a floodplain development permit may still apply, septic approval still comes from DEQ, and incorporated cities and towns can have different rules22356. Oklahoma treats an occupied manufactured home as a permanent installation and requires installation under the applicable HUD standards or approved manufacturer instructions; the installer must be properly licensed36. We could not confirm whether McClain County requires a certificate of occupancy or performs building inspections outside its published permit processes, so ask the Floodplain Administrator before placing or occupying a structure920.

Building a home in McClain County: the steps, in order

  1. Confirm whether the parcel is unincorporated or inside a municipality, because municipal zoning and building rules vary6.
  1. Ask the Floodplain Administrator whether the project enters the county floodplain process; covered applications require the development's latitude and longitude2320.
  1. If a drive will attach to a county road, use the Road Connection Application; if work crosses a county road, follow the separate road-crossing process225.
  1. Arrange the septic evaluation and obtain DEQ's Authorization to Construct before installing or modifying a system3231.
  1. Confirm that any domestic well use fits the state exemption; qualifying household and limited irrigation uses do not require a groundwater-use permit18.
  1. If you will file a plat at the courthouse, have it reviewed first by the McClain County 9-1-1 Trust Authority, which can take up to ten business days37.
  1. Before construction, ask the Floodplain Administrator whether any county inspection or occupancy step applies, because we could not confirm those requirements920.

What to check before you buy land in McClain County

Confirm the jurisdiction first: unincorporated McClain County has no county zoning, but Blanchard and Washington have zoning programs, and municipal building rules can differ167. For a tract created through residential development outside a city or town, ask for the approved plat: it must describe water and sewage methods, and DEQ approval is required before recording, sale or construction14. A county clerk cannot record such a plat with a lot under 2.5 acres unless it carries DEQ's approval stamp14. Check the septic site early because only 28% of county soils are rated without severe limits for a conventional drain field33. Also verify floodplain status and legal road access before closing, since the county administers separate floodplain, road-connection and road-crossing processes2.

Watch-outs

  • We could not confirm whether McClain County requires a certificate of occupancy or building inspections outside its published permit processes, so ask the Floodplain Administrator before construction920.
  • Starting November 1, 2025, anyone who isn't a DEQ-certified installer may install only one on-site sewage system per calendar year, a limit worth knowing before you plan to do your own septic work32.
