Sullivan County, Tennessee

Zoning, building permits and septic rules in Kingsport, Tennessee

Kingsport, Tennessee requires a city building permit before work starts on any structure beyond cosmetic repairs1. The city also runs its own zoning under Chapter 114 of its code2. Septic permits are a separate track: Sullivan County's septic program is run by the state's Tennessee Department of Environment and Conservation (TDEC), and we could not confirm a different rule inside the city3.

Does Kingsport, Tennessee have zoning?

Yes. Kingsport's zoning ordinance is Chapter 114 of the city code, kept current by the city Planning Division, with changes approved by the Kingsport Regional Planning Commission and the Board of Mayor and Aldermen2. It applies to land inside Kingsport city limits, not to unincorporated Sullivan County.

What the ordinance allows on a given lot depends on its zoning district. We could not confirm Kingsport's rules on RVs, tiny homes, accessory dwellings, minimum lot size or setbacks, so check the district for the exact parcel before you buy. The Planning Division at (423) 229-94858 answers zoning questions for parcels inside the city.

Subdividing land is regulated too: a plat cannot be recorded by the Sullivan or Hawkins County Register without final written Planning Commission approval9.

Do you need a building permit in Kingsport, and who issues it?

Kingsport requires a building permit for anything other than cosmetic repairs such as painting or carpet, and the permit must be bought before work starts1. The City of Kingsport Building Department, not Sullivan County, issues these permits for work inside city limits10. Inspections follow the permit11.

The city's published minimum building permit fee is $30 for construction costing $1.00 to $2,000, and a $7 technology fee applies to all permits12. Working without a permit doubles the permit fee12.

For a single-family home the application needs a set of plans (not required to be stamped), the job cost and the address13.

Can you build your own house in Kingsport?

Yes, with conditions. The city lets a homeowner do their own work if they own and occupy the house, but a homeowner still needs the same permit as everyone else4. On rental property, electrical, plumbing and mechanical work must be done by licensed contractors4.

Tennessee's separate owner-builder exemption lets an owner build one residence for their own use with one permit every two years, provided the home is not for sale, lease or rent14. Anyone the owner pays more than $25,000 counts as a prime contractor and must be licensed14.

How do septic permits work in Kingsport?

Septic permits in Kingsport are not a city building-department matter. Sullivan County is not one of Tennessee's contract counties, so septic permitting there is run by TDEC, the state environmental department315. The Johnson City Environmental Field Office serves Sullivan and Hawkins counties, and Kingsport lies in both16.

Tennessee requires a septic permit before a system is built, changed or repaired, and the state advises getting it before any dirt work, including the building pad17. A final inspection is required after installation18.

We could not confirm a septic rule written specifically for land inside city limits, or a rule on when a new home must connect to city water or sewer. Call the Building Department at (423) 229-939310 and the TDEC field office at (423) 854-540016 before you plan any on-site system.

Building a home in Kingsport: the steps, in order

  1. Ask the Planning Division at (423) 229-9485 which zoning district the parcel is in and what it allows8.
  2. Confirm whether the lot has city sewer, and if not, contact the TDEC Johnson City field office at (423) 854-5400 about a septic permit16.
  3. Check whether any part of the lot lies in a FEMA-mapped floodplain; development there needs a floodplain development permit6.
  4. Get a driveway permit through the city's Traffic Department; commercial driveways on a state route also go to TDOT for review5.
  5. Apply for the building permit with plans, job cost and address before any work begins13.
  6. Call for inspections as work proceeds; after the final inspection a certificate of occupancy is issued, and only then can you move in10.

What stays with Sullivan County, and what to check before you buy

Kingsport's rules apply only inside city limits. For land outside the city, Sullivan County's page covers the county's rules for unincorporated land, which run through a different office.

Tennessee leaves floodplain development to the local community, so inside city limits the city's floodplain administrator is the contact19. Conventional septic is a real question in this county: only about 2.3% of Sullivan County soils are rated not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system20. Sullivan County's effective property tax rate is about 0.6%7.

Watch-outs

  • We could not confirm Kingsport's rules on RV or tiny-home living, accessory dwellings, minimum lot size or setbacks; ask the Planning Division at (423) 229-9485 before you buy8.
  • Kingsport lies in both Sullivan and Hawkins counties, and its subdivision rules also reach the surrounding Kingsport Planning Region, so check which jurisdiction a parcel on the city edge falls under9.
  • Starting work without a permit doubles the permit fee12.
