Nationally, Tennessee ranks #4 for homesteading and #5 for off-grid living.

Tennessee has 19 counties where a residential building permit is not required for unincorporated land.1 Tennessee has 27 counties without countywide zoning; city rules differ.2 Septic permitting runs through the Tennessee Department of Environment and Conservation or designated contract counties, while RV and tiny-home occupancy need a county-specific answer.345

Which Tennessee counties don't require a building permit?

For unincorporated land, 19 Tennessee counties do not require a residential building permit, 17 require one only in some cases, and 59 require one.167 The first counties to consider without a residential building permit are Pickett County, Stewart County, Hancock County, Bledsoe County, Humphreys County, Lewis County, Houston County, Decatur County.1 Use the Tennessee no-building-codes list to compare those counties.1

The State Fire Marshal’s residential program applies where local enforcement or an opt-out does not displace it, using the 2018 residential and energy codes with amendments.13 State-program building permits are purchased online or from an Issue Agent, with foundation, framing/rough-in and final inspections.14 Tennessee’s owner-builder exemption covers a residence for individual use, not sale, lease or rent; it allows one permit every two years and requires licensing for anyone paid more than $25,000.11 See the owner-builder county list alongside the state exemption conditions.11

Which Tennessee counties have no zoning?

Tennessee has 27 counties without countywide zoning and 54 with countywide zoning; we could not confirm zoning in 14 counties.289 Counties without countywide zoning include Fentress County, Stewart County, Hancock County, Van Buren County, Lewis County, Clay County, Hardin County, Houston County.2 Compare the Tennessee no-zoning list.2

For buyers seeking both fewer building approvals and no countywide zoning, 10 counties have neither a residential building-permit requirement nor countywide zoning, led by Stewart County, Hancock County, Lewis County.10 The no-building-codes and no-zoning list narrows that search.10 Tennessee’s agricultural county-zoning exemption requires structures incidental to an agricultural enterprise and has highway, airport, park and floodplain exceptions; the exemption does not apply to municipalities.15

Who issues septic permits in Tennessee?

Tennessee’s county totals identify a state septic agency in 87 counties, a multi-county health district in 2 and a county office in 6, with TDEC the most commonly named agency.16 For application routing, the state’s contract-county list names Blount, Davidson, Hamilton, Jefferson, Knox, Madison, Sevier, Shelby and Williamson; applications for those locations go directly to the contract county.3

Tennessee requires a septic permit before construction, modification or repair, and the septic permit should precede building-pad work.17 A conventional system permit costs $400 and an alternative system permit $500 for design flow up to 1,000 gallons per day; higher flows carry additional fees.17 Construction inspections cost $100 for a new conventional system or $200 for an alternative system, and the system must be inspected before covering.18 TDEC conducts a site evaluation, so resolve wastewater feasibility before committing to a house location.19

Can you live in an RV or tiny home on your land in Tennessee?

Tennessee RV occupancy has county-specific answers for 26 counties: 10 allow it, 2 allow temporary occupancy only, 12 have limits and 2 prohibit it; the other 69 are unanswered, not presumed allowed.4 The allowed group starts with Van Buren County, Lewis County, Overton County, but those answers concern county land-use restrictions, with septic and other requirements still relevant.4 Explore the Tennessee RV-living list.4

Tiny-home occupancy has answers for 21 counties: 11 allowed and 10 limited, leaving 74 unanswered.5 The allowed group begins with Stewart County, Overton County, Henry County; these county land-use answers do not settle building-code or wastewater compliance.5 Compare the Tennessee tiny-home list.5 We could not confirm a statewide private-land occupancy answer for either housing type; ask the parcel’s building and zoning authority and TDEC’s SSDS Program before planning residential use.4519

Where are the best Tennessee counties for a bolthole?

The highest Bolthole Index scores belong to Fentress County, Pickett County, Stewart County, Hancock County, Van Buren County, Bledsoe County, Humphreys County, Lewis County.20 Fentress scores 91 and has limited residential building-permit requirements, no countywide zoning and state septic administration; Pickett scores 89 and has no residential building-permit requirement, unconfirmed zoning and state septic administration.20 Stewart scores 88 and combines no residential building-permit requirement, no countywide zoning and state septic administration.20

For a cost comparison, the median county farmland value is $5,222 per acre; the lowest-value counties start with Chester County, Hardeman County, Decatur County.21 Tennessee’s median county effective property-tax rate is 0.5%, and its median county tax bill is $865 annually.12 Use those medians as county comparison figures rather than a parcel quotation, and pair the shortlist with septic feasibility and local floodplain review before buying.21121922

What should Tennessee buyers know about water, wells and access?

Tennessee’s water-rights summary describes a riparian regime, with withdrawal registration above 10,000 gallons per day and agricultural and domestic exemptions.23 Shelby County is listed within the Shelby County Ground Water Quality Control Board managed area for the Memphis Sand aquifer.23 We could not confirm a separate statewide property-owner well-permit requirement; ask TDEC’s Water Well Program about the proposed well, distinguishing withdrawal registration from drilling requirements.24

A Tennessee utility system with the specified sewer-bond authority may require an existing building to connect when its parcel abuts a public way containing sanitary sewer.25 For access, construction or a change to an existing driveway on state highway right-of-way requires a TDOT permit, including a change in use.26 Floodplain development is reviewed locally, so contact the city administrator inside city limits or the county administrator outside them before grading or placing structures in a regulated floodplain.22

Watch-outs

  • Tennessee county zoning counts concern unincorporated land; county zoning authority stops at municipal corporations.27
  • Tennessee residential-code opt-out resolutions expire after legislative elections unless renewed, so confirm current coverage with the State Fire Marshal’s Office before building.13
  • No residential building permit does not remove Tennessee septic requirements or local floodplain review; ask the county floodplain administrator outside city limits and the city administrator inside them.1722
  • We could not confirm the current Tennessee conditions for composting toilets or pit privies; ask TDEC’s SSDS Program about the proposed sanitation system before buying.19
