Do you need a building permit in Waller County, Texas?

Yes. Residential development in unincorporated Waller County requires development, driveway and septic permits, and the county must issue a 9-1-1 address before issuing any county permit19. A structure or concrete slab measuring at least 100 square feet triggers a development permit; floodplain work, qualifying earthwork and development of improved or unimproved land are also listed permit categories2.

Waller County Engineering identifies inspections of county-road construction, commercial driveways and subdivision development; its published scope does not establish a general home-construction inspection program10. The separate fire-code program covers commercial establishments, public buildings and multifamily residential structures with at least 4 units, not ordinary single-family construction11. Waller County does not issue certificates of occupancy12.

Inside Waller city limits, updated city building codes took effect October 1, 2026; the county development rules above apply to unincorporated land132. For private septic systems, contact the Waller County Environmental Division before installation to confirm jurisdiction1415.

Who issues Waller County building permits, and how do you reach them?

The Waller County Road and Bridge & Engineering Department handles county development and residential building permits16. Its office is at 775 Bus 290 East, Hempstead, TX 77445, and the phone number is (979) 826-767016. The office is open Monday through Thursday from 8:00 a.m. to 4:30 p.m. and Friday from 8:00 a.m. to noon16.

Obtain the parcel's 9-1-1 address first, then use the county's MGO Connect portal for listed permits; wait until the application has a project number and an assessed fee before paying9. Contact the Waller County Environmental Division separately for private septic permits17. Covered commercial, public and multifamily projects also go through the Fire Marshal's Office at 979-826-7785 or wcfmo@wallercounty.us1118.

Does Waller County have zoning?

Waller County does not enforce zoning in unincorporated areas3. Inside Katy city limits, Katy sets its own zoning; private septic applicants should contact the Waller County Environmental Division to confirm whether the county order or another existing order governs the address1915.

Unincorporated Waller County has no county zoning-based minimum dwelling size, lot size, setback, lot-coverage or height limit, or zoning prohibition on accessory dwellings, RVs, tiny homes, manufactured homes or temporary camping5. Development, floodplain, septic and driveway requirements still apply, and a subdivision plat exemption does not remove applicable septic lot-size requirements320.

How do septic permits work in Waller County?

Waller County's Environmental Division administers the county septic order, which excludes areas regulated under another existing order, ordinance or resolution15. Within that jurisdiction, every on-site sewage facility needs a permit regardless of acreage4. Contact the division before installation at 425 FM 1488, Hempstead, TX 77445, by phone at (979) 921-0391 or by email at t.mewis@wallercounty.us21. Applicants choose the residential or commercial on-site sewage facility project in MGO Connect and provide the appraisal district property ID22.

The published septic schedule, effective in 2020, lists $310 for a single-family system covering the application, permit, preliminary review, inspections and approval notice; starting before the permit doubles permit fees23. The installer of record must attend the final inspection, and a failed final inspection must be reinspected within 10 days24. Only 4.9% of Waller County soils are rated without severe limits for a conventional drain field, so arrange the site evaluation early25.

Can you live in an RV or tiny home on your land in Waller County?

RV and tiny-home plans on unincorporated Waller County land still face development and sanitation requirements: a structure or slab of at least 100 square feet triggers a development permit, and residential development requires driveway and septic permits21. Off-grid private septic systems must be designed, permitted, installed and maintained under state and local requirements; ask the Environmental Division before installation26.

An owner may perform electrical work on a dwelling the owner owns and occupies without a state electrician license, but the exemption does not waive applicable permits, inspections or electrical codes, and municipal or regional rules may override it7. For a manufactured-home rental community subject to an Infrastructure Development Plan, utility service requires a County Engineer-issued Certificate of Compliance27.

How do you arrange development and driveway permits in Waller County?

Obtain a 9-1-1 address before county permit issuance, then apply through MGO Connect; wait for a project number and assessed fee before paying9. Residential development in unincorporated Waller County requires development, driveway and septic permits1.

For county driveway and culvert work, construction must begin within 3 months and finish within 6 months of the permit date; culverts must be at least 10 feet from the property line28. When a private contractor sets the culvert pipe, notify the county for inspection before backfill28. A driveway onto a state highway instead needs an executed TxDOT driveway permit before right-of-way work29.

What should you check before buying land in Waller County?

Before buying unincorporated Waller County land, investigate septic feasibility, flood exposure and access: only 4.9% of county soils lack severe limits for a conventional drain field, floodplain work requires county permitting, and county-road driveway connections require a permit25308. An improperly divided tract will not receive addresses or permits from Engineering, and dividing a parent tract already in a subdivision requires a replat20.

Lots subject to Waller County recorded plat restrictions must have water, sewer or septic, electrical and available gas connections that meet or will meet minimum state standards31. We could not confirm water-well permit requirements or agricultural permit exemptions; ask Engineering which requirements and authorities apply to the parcel16.

Watch-outs

  • No county zoning does not remove the development, driveway and septic permits required for residential development in unincorporated Waller County31.
  • The county septic order requires a permit regardless of acreage within its jurisdiction; areas governed by another existing order are excluded4.
  • Waller County does not issue certificates of occupancy, but covered fire-code buildings in unincorporated areas need a final, conditional or partial certificate of compliance before occupancy121132.
