Do you need a building permit in Fairfax County, Virginia?

Yes. Fairfax County requires a building permit for a new detached house, duplex or townhouse, with applications submitted through PLUS1. New applications and construction must follow the 2021 code requirements; technical provisions from different editions cannot be mixed13. The statewide code that Fairfax County enforces exempts a one-story detached storage shed or playhouse of 256 square feet or less and a detached utility building of 150 square feet or less from building permits, but the building official may still require a permit for exempt items in a special flood hazard area1415. A qualifying nonresidential farm building used primarily for farming is exempt from the Building Code, except for a farm building or portion operated as a licensed restaurant; applicable flood-proofing rules still remain16. Residential projects must pass required building and trade inspections before occupancy2. Fairfax County requires occupancy approval for a new structure or premises or a change in use, and the residential approval is a Residential Use Permit3.

Who is the Fairfax County building department, and how do you reach it?

Fairfax County Land Development Services handles building permit applications, plan review and inspections at 12055 Government Center Pkwy, Fairfax, VA 22035; call 703-222-0801 or email landdevelopmentservices@fairfaxcounty.gov17. The Department of Planning and Development's Zoning office answers parcel-use and setback questions at 703-222-1082 or dpdzoningpermits@fairfaxcounty.gov18. Fairfax County publishes its permitting workflow through Land Development Services and PLUS; the application may require plans, professional credentials, fees, inspections and occupancy approval depending on the project19. Covered work needs a permit before it begins, although the building official can authorize work while an application is pending in specified circumstances20. New homes require building permits, and new structures, new premises and changes in use require occupancy approval13.

Does Fairfax County have zoning?

Yes. Fairfax County's Zoning Ordinance regulates land uses and structures through distinct zoning districts21. Use the county's Zoning District Analyzer to identify the parcel's district before applying its allowed uses and dimensional requirements9. Setbacks vary by structure and parcel: an accessory structure between 8.5 and 12 feet high must sit at least 5 feet from side and rear lot lines, while taller structures face different rules22. One accessory living unit may accompany a single-family detached dwelling, subject to location, size, occupancy, owner-occupancy, recordation and permitting conditions; Health Department approval is required when the property uses a well or septic system12. Short-term lodging is allowed as an accessory use in residential-permitting districts but not in an accessory living unit or detached accessory structure23. We could not confirm one countywide minimum home or lot size, so ask Zoning about the parcel's district18.

How do septic permits work in Fairfax County?

The Fairfax County Health Department administers state and local rules for onsite sewage systems and private wells5. The department reviews installation drawings, issues septic construction and repair permits, and performs installation-related inspections67. Alternative systems require an inspection within 180 days after approval and annually afterward7. Published new-construction fees for a sewage system with flow no more than 1,000 gallons per day include a $200 county fee and a $215 state fee, with other fees potentially applying24. Geothermal wells in Fairfax County require a Health Department permit and a licensed Well Water Supply Provider25. Only about 9.1% of county soils lack severe limitations for a conventional drain field, so arrange a site evaluation early26. When public sewer service is available in the approved service area, a connection permit and paid sewer fees are required27.

Can you live in an RV or tiny home on your land in Fairfax County?

Fairfax County prohibits using or occupying an RV for human habitation on public property or in a street, alley or other public right-of-way, except in a designated public campground, recreational park or licensed mobile home park11. We could not confirm a complete Fairfax County rule allowing long-term RV living or tiny-home occupancy on an ordinary private residential lot, so ask the Zoning office before treating either as a lawful dwelling18. Virginia's campground permit rules do not establish a right to live in an RV on a private residential lot28. Fairfax County provides a narrow temporary manufactured-home route after a detached home is damaged or destroyed: the lot must allow that house type, approved sanitation is required, and the administrative permit lasts no longer than 9 months or the active building-permit period, whichever is shorter29.

Building a home in Fairfax County: the steps, in order

  1. Use the Zoning District Analyzer, then confirm the parcel's allowed use and applicable setbacks with the Zoning office918.
  2. Request a floodplain use determination if development is proposed in or near a regulatory floodplain30.
  3. Determine whether public sewer is available; otherwise begin onsite-sewage review with the Health Department276.
  4. Obtain a VDOT land-use permit before constructing or modifying an entrance on a state-maintained road31.
  5. Apply through Land Development Services and PLUS; an owner using the contractor-license exemption must submit a notarized affidavit before permit issuance11017.
  6. Schedule and pass the required building and trade inspections2.
  7. Receive the Residential Use Permit before moving into the home3.

What should you check before buying land in Fairfax County?

Start with the parcel's zoning district, because Fairfax County's published district rules determine permitted uses and requirements9. Confirm public-sewer availability before pricing the site: a buildable-looking parcel may instead need onsite-sewage approval, and only about 9.1% of county soils lack severe limits for a conventional drain field27626. Check whether access touches VDOT right-of-way, because a new or modified entrance on a state-maintained highway requires a land-use permit31. Development in or near a regulatory floodplain requires a county floodplain use determination30. Typical county property-tax bills are about $7,072 per year at an effective rate near 1%3233.

Watch-outs

  • A Fairfax County owner-builder license exemption is conditional, not a building-permit exemption: the property owner must submit a notarized license-exemption affidavit before permit issuance10.
  • An accessory living unit must share the principal dwelling's driveway and curb cut; a proposed garage or carport must directly adjoin an existing one34.
  • RV habitation is prohibited in Fairfax County public rights-of-way, while ordinary private-lot RV or tiny-home occupancy remains unconfirmed; ask the Zoning office before purchase or placement1118.
  • Virginia law taking effect July 1, 2027 will require localities to treat accessory dwelling units as a permitted accessory use in single-family residential zoning districts, subject to listed conditions; Fairfax County's current accessory living unit rules stay in force until then, so confirm with the Zoning office before relying on either3518.

  • county building authorityGeneral

Virginia counties administering and enforcing the Uniform Statewide Building Code and issuing building permits for construction, including residential construction, in county jurisdiction.

    • Virginia's building code is a Uniform Statewide Building Code adopted by the State Board; it supersedes county building codes and regulations.
    • The county's role is local administration and enforcement through a local building department, not independent adoption of a conflicting county building code.
    • A county without a building department or local board of Building Code appeals must enter an agreement with another county, municipality, agency, or approved state agency for enforcement and appeals.
    • A town with a population of less than 3,500 may elect to administer and enforce the Building Code; if it does not, the county administers and enforces the Code for that town.

    • Building permit and enforcement fees may be levied by the local governing body.

[...] Whenever a county or a municipality does not have such a building department or board of Building Code appeals, the local governing body shall enter into an agreement with the local governing body of another county or municipality or with some other agency, or a state agency approved by the Department for such enforcement and appeals resulting therefrom.”

The aquifer here is over-appropriated and declining. A domestic well is usually still permit-exempt, but long-term supply is a genuine risk.

Household wellExempt — no permit or water right

Household wells are exempt from the groundwater withdrawal permit even inside a Groundwater Management Area, but a private well in a GWMA must be registered with DEQ within 30 days (Va. Code 62.1-258); a permit is triggered only at 300,000 gal/month.

Limit: < 300,000 gal/month (no withdrawal permit)

DEQ has imposed mandatory withdrawal reductions on large Coastal Plain permittees because permitted demand exceeds sustainable aquifer yield (declining heads, land subsidence, saltwater-intrusion risk). Household wells (<300,000 gal/mo) are exempt but must be registered. The I-95-west counties (Fairfax, Chesterfield, Hanover, Henrico, Prince William, Spotsylvania, Stafford, Caroline) are included only east of I-95.
