Do you need a building permit in Pendleton County, Kentucky?

Pendleton County requires a zoning permit for all new construction, including a house, an addition, an accessory structure or a fence.910 A zoning permit is not the same as a building permit, and the county's page does not say that a separate building permit is required for a single-family home.1 Kentucky itself does not require a permit, inspection or certificate of occupancy for a single-family dwelling unless a local ordinance requires one.3

The county zoning ordinance does make a certificate of occupancy part of the process: no building may be used until the Building Inspector issues one.11 Any home must still follow Kentucky's residential code.12 Ask Planning & Zoning which building, electrical, plumbing and HVAC approvals apply; the county lists separate inspection contacts for electrical, HVAC, plumbing and sanitary sewage.13

Who issues zoning permits and building permits in Pendleton County?

The Pendleton County Department of Planning & Zoning at 233 Main Street in Falmouth issues zoning permits for unincorporated Pendleton County and the City of Falmouth.14 The same office handles zoning maps, floodplain management, right-of-way encroachment permits, addressing, code enforcement, development-plan review and subdivision review.14 Its applications page offers a residential permit application and says zoning permits are required for all new construction.10

Septic permits are not handled there: Three Rivers District Health Department issues them for every address in the county, city or not.4 Electrical inspectors work under contract with the Pendleton County Fiscal Court, while HVAC and plumbing inspections come from state divisions.13 The county publishes a fee schedule on its applications page; the amounts are in that download, so confirm the current figure with the office.15

Does Pendleton County, Kentucky have zoning?

Yes. Pendleton County zones its unincorporated areas, and the Planning & Zoning office also administers zoning for the City of Falmouth.2 The ordinance names a Rural Zone and Commerce Zones, which include a Business Zone and an Intensive Zone.16 In the Rural Zone, no minimum lot area applies beyond what the ordinance and septic rules require, so soils and the health department's site evaluation set the practical lot size.17

The Commerce Zone caps building height at 40 feet.18 The reviewed ordinance did not give a minimum dwelling size, a lot-coverage limit or a rule for accessory dwellings, so ask Planning & Zoning before siting a second dwelling. Land used for agriculture as defined in KRS 100.111(2) is largely outside the ordinance, but street setbacks, floodplain rules and certificate-of-occupancy requirements for dwellings still apply.19 Dividing land requires review by the Joint Planning Commission.20

How do septic permits work in Pendleton County?

Three Rivers District Health Department administers septic permits in Pendleton County, from its Pendleton County Health Center in Falmouth.421 The process starts with an onsite evaluation of the site and soil, after which a certified installer submits a design layout and a construction-permit application to the health department.21 A homeowner who wants to install their own system must obtain a homeowner's permit through the local health department.5 Every installed, constructed, altered or repaired system must be inspected by a certified inspector.22

Soil is a serious planning issue: only about 1.2% of mapped soils avoid a very limited rating for a conventional drain field.23 That does not decide an individual lot, but a site evaluation before purchase is wise. Kentucky prohibits cesspools, seepage pits and dry wells as sewage disposal, with narrow exceptions for repairs.24

Can you live in an RV or tiny home in Pendleton County?

In unincorporated Pendleton County, living in an RV on a lot that already has a principal residence is limited to 30 days per year.6 On a lot with no house, a zoning-administrator permit is required, it may be issued for at most 6 months out of one calendar year, and any period beyond 6 months is prohibited.6 The permit must be posted visibly on the RV.6

Special-event camping is a separate, narrower category: it needs a county permit, a lot of at least 5 acres, stays of no more than 14 days, and soft-sided tents only, with RVs and travel trailers excluded.25 We could not confirm a county rule that names tiny homes as their own category. A tiny home built as a dwelling still needs a zoning permit as new construction and must meet Kentucky's residential code.112 Describe the structure, foundation and intended occupancy to Planning & Zoning and Three Rivers before closing.

Building a home in Pendleton County: what are the steps?

  1. Call Pendleton County Planning & Zoning with the parcel number to confirm the zoning district and use, and to ask whether a separate building permit applies.141
  1. Arrange a Three Rivers site evaluation, then obtain the septic construction permit before any system work begins.2126
  1. Get the new driveway approved, with a culvert if needed, before a permit is issued and an address assigned; contact Planning & Zoning first to start an address or utility hook-up.727 For an entrance on a state highway, apply in writing to the Kentucky Department of Highways district engineer.28
  1. Apply for the county zoning permit before construction starts.10
  1. Obtain a plumbing permit before installing or altering plumbing; homeowners may receive one for plumbing in their own personal residence.29
  1. Obtain the certificate of occupancy from the Building Inspector before moving in.11

What should you check before buying land in Pendleton County?

Confirm zoning, floodplain status, legal access, sanitation and utilities before the due-diligence period ends. Pendleton County Ordinance No. 340.6 regulates development in flood-prone areas and is incorporated into the zoning ordinance, and Kentucky separately requires a state floodplain permit in identified floodplains.3031 Buildings in a designated floodway or floodplain stay fully regulated even on agricultural land.19

Order the septic site evaluation early because only about 1.2% of county soils are mapped without severe limits for a conventional drain field.23 About 43.4% of the county's land is at a slope of 15% or less, so grading and usable building area matter alongside acreage.32 Kentucky requires no owner permit or fee for a private well, but a certified water well driller must do the work.8 The county's effective property-tax rate is about 0.8%, and the median annual bill is about $1,246.3334

Watch-outs

  • A county zoning permit is confirmed for all new construction, but a separate single-family building permit is not; ask Planning & Zoning before work begins.13
  • An RV on a lot with a house is limited to 30 days per year, and an RV on a bare lot needs a zoning-administrator permit capped at 6 months a year.6
  • Only about 1.2% of mapped county soils avoid a severe limitation rating for conventional septic drain fields, so make the site evaluation a purchase contingency.23
  • Floodplain development needs both county and state approval; Planning & Zoning handles the local floodplain review.3031
