Which Kentucky counties don't require a building permit?

Kentucky has 25 counties without a residential building-permit requirement, 32 with requirements limited to particular cases, and 63 requiring residential building permits.289 The highest-scoring counties in the no-permit group are Wayne County, Butler County, Green County, Russell County, Livingston County, Morgan County, Ohio County, Webster County.2

Use the Kentucky no-building-codes list to find counties without a residential building-permit requirement, but Kentucky's mandatory residential code still applies statewide.216 For a single-family dwelling, building permits are required only where a local ordinance requires them.1 Separate plumbing permits remain required before plumbing construction, installation or alteration; homeowners may obtain them for their own personal residences.17 Owner-occupied HVAC work has a licensing exemption, but an initial HVAC installation still requires an HVAC permit before work begins.14

Which Kentucky counties have no zoning?

Kentucky has 52 counties without countywide zoning and 46 with zoning; we could not confirm zoning in the remaining 22 counties.31011 The highest-scoring no-zoning counties are Wayne County, Butler County, Green County, Lee County, Russell County, Livingston County, Metcalfe County, Monroe County.3

The Kentucky no-zoning list helps narrow the search, and the no-building-permit and no-zoning list identifies the 19 counties with both answers.312 Kentucky allows cities and counties to adopt zoning texts and maps through local planning units, so ask the planning commission which jurisdiction and district govern the parcel.4 Within a planning-unit jurisdiction, subdivision approval is a separate requirement before dividing land and recording the plat.18 Agricultural land is not a blanket housing exemption: Kentucky allows regulation of dwellings and floodplain structures even under its agricultural zoning protections.19

Who issues septic permits in Kentucky?

Kentucky septic permits are administered through local health departments: 80 counties are served by multi-county districts and 40 by county offices.13 Lake Cumberland District Health Department is the most frequently named district in the county answers.13 The Kentucky Onsite Sewage Disposal Systems Program can answer statewide program questions, while the local health department evaluates the site and soil.20

Obtain the septic construction permit before constructing, installing or altering any portion of the system; the application follows a site evaluation and requires drawings, specifications and permit fees.21 The septic permit expires 1 year after issuance unless the Cabinet grants an extension.21 Arrange the installation inspection before backfilling.22 A homeowner installing a personal system needs a homeowner's permit from the local health department.23 Where public sewer is unavailable, Kentucky requires an approved private sewage disposal system for buildings subject to its plumbing code.24

Can you live in an RV or tiny home on your land in Kentucky?

Kentucky RV living has county-level answers in 31 counties: 18 allow it within the stated scope, 2 allow temporary use only, 8 impose limits and 3 prohibit it.6 The remaining 89 counties are unanswered, rather than presumed allowed or prohibited.6 Start with Wayne County, Lee County, Metcalfe County, Estill County, whose allowed answers concern county land-use regulation on unincorporated land.6 The Kentucky RV-living list links the county-specific conditions.6

Kentucky tiny-home occupancy has answers in 26 counties: 21 allowed and 5 limited; 94 counties remain unanswered.7 Wayne County, Lee County, Metcalfe County, Estill County have allowed county land-use answers, with conditions explained on their pages and the Kentucky tiny-home list.7 A tiny home built as a dwelling still falls under applicable Kentucky residential-code requirements, and an onsite sewage system needs its own approval.1621 Kentucky's temporary-vehicle-sleeping provision concerns lawful parking on public roads, streets or parking lots; it does not establish permanent RV occupancy rights on private land.25

Where are the best Kentucky counties for a bolthole?

Wayne County leads Kentucky's Bolthole Index scores at 75, followed by Butler County and Green County at 74; all have no residential building-permit requirement, no countywide zoning and district-administered septic.26 Lee County and Russell County also score 74 and have no countywide zoning and district septic, but Lee has a limited building-permit requirement while Russell requires none.26 Livingston County, Metcalfe County and Monroe County score 73 and have no countywide zoning; their building-permit answers are none, limited and required respectively, with district septic in Livingston and Metcalfe and county septic in Monroe.26

The median county farmland value is $4,347 per acre; Leslie County has the lowest listed value at $1,450 per acre.27 These are farmland-value comparisons, not asking prices for a particular parcel.27 The median county effective property-tax rate is 0.7%, and the median county tax bill is $935 annually.28

What are Kentucky’s water, well and access requirements?

Kentucky's water regime exempts domestic and agricultural uses from withdrawal permitting, while the general withdrawal threshold is above 10,000 gallons per day.29 For constructing or abandoning a private water well, Kentucky requires no property-owner permitting application or fee; construction, modification and abandonment must be performed by a Kentucky Certified Water Well Driller.15 The driller must submit the required documentation within 60 days after completion.15 Ask the Division of Water's Well Driller Certification Program for technical assistance on well construction and maintenance.30

Before planning highway access, a new or additional farm or single-family driveway approach on Department of Highways right-of-way requires a formal written application to the District Engineer.31 Development in an identified Kentucky floodplain needs state and local floodplain permits, including in mapped A and AE zones.32 A county's no-building-permit answer therefore does not remove floodplain or septic approvals.23221

Watch-outs

  • County counts concern unincorporated land; cities may adopt their own zoning, so ask the local planning commission which rules cover the address.34
  • Kentucky counties can adopt building-permit requirements and zoning; confirm the current ordinance with the county building official and planning commission before buying.3334
  • Floodplain development permits and septic approvals remain separate requirements where no residential building permit is required.32212
  • We could not confirm a statewide tiny-home occupancy rule or numeric minimum home size, minimum lot size, setbacks, lot coverage or general building-height limit; ask the local planning commission and Kentucky Division of Building Code Enforcement about the proposed dwelling.435
