Zoning, building permits and septic rules in Falmouth, Kentucky

Falmouth, Kentucky has its own zoning ordinance, and the city's zoning administrator must issue a zoning permit before any building is erected, moved, enlarged or any lot is graded1. Whether the city also requires a separate building permit for a house we could not confirm, so ask the city planning office. Septic permits and site evaluations come from the Three Rivers District Health Department, not the city2.

Does Falmouth, Kentucky have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Falmouth Zoning Ordinance divides all land inside the city into rural, commerce, urban residential, suburban residential and downtown zones, plus historic overlay districts3. Dimensional rules change by district, so find the parcel on the city zoning map before you plan anything.

  • Urban residential (UR): minimum lot area 5,000 square feet, front yard 20 feet, side yards 3 feet, rear yard 5 feet, maximum height 40 feet71213.
  • Suburban residential (SR): minimum lot area 10,000 square feet, front yard 30 feet, side yards 5 feet, rear yard 10 feet, maximum height 30 feet81415.
  • Rural (R): no zoning minimum lot area, front yard 50 feet, side yards 5 feet, rear yard 5 feet916.

Lots with frontage on U.S. Highway 27 has a 25-foot setback from the right-of-way instead of the front-yard figure14. Where sewer does not serve a Falmouth lot, the lot area needed for septic can exceed these minimums8.

Do you need a building permit in Falmouth, KY, and who issues it?

Inside Falmouth, a zoning permit from the zoning administrator's office is required before any building or structure is erected, moved, added to or structurally altered, and before any grading on a lot1. A zoning permit expires if a required building permit is not obtained within 120 consecutive calendar days, and building without a zoning permit is a violation1.

The city's own planning and zoning page says commercial, multi-family and public-use construction inside Falmouth needs a commercial building permit from the state, a floodplain permit where applicable, and a zoning permit where applicable17. For a single-family house, Kentucky's residential code says permits, inspections and certificates of occupancy are not required unless a local ordinance requires them18. We could not confirm whether Falmouth has adopted such an ordinance, so ask the City of Falmouth Planning & Zoning office at 230 Main Street before you rely on that17.

The zoning fee schedule is linked from the city's page; we did not find the dollar amounts17.

How do septic permits work inside Falmouth, KY?

Septic is not a city permit. Kentucky's onsite sewage program is administered through local health departments19, and for Pendleton County that is the Three Rivers District Health Department2. The department's first step is an onsite evaluation of site and soil, and then a certified installer submits a system design and a construction permit application20.

Whether you may use a septic system at all depends on where the lot sits. Falmouth's zoning ordinance allows individual on-site sewage disposal only in areas not currently served by a centralized sanitary sewer system4, and requires a new building with access to public water or sewer to connect to it5. A lot on the city sewer line therefore does not get a septic field.

For lots without sewer, a homeowner who wants to install their own system must get a homeowner's permit from the local health department21. Across Pendleton County, USDA rates only 1.2% of soils as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system22.

Can you live in an RV, tiny home or manufactured home in Falmouth?

We could not confirm whether Falmouth allows living full time in an RV or a tiny home on a lot; call the City of Falmouth Planning & Zoning office before you buy. The ordinance's rural-zone use list does allow recreation vehicle camping grounds, but only for transient or seasonal use that meets Kentucky's recreational vehicle park statute6. That is a campground rule, not permission to live in an RV on your own lot.

Mobile, manufactured and qualified manufactured homes are regulated by section 6.17 of the ordinance in the urban residential zone10, and are listed as a permitted use in the suburban residential zone11. Section 6.17 requires federal manufactured housing certification before a unit is moved into the city10.

Outside city limits the answer differs: in unincorporated Pendleton County, living in a vehicle on a lot that already has a house is limited to 30 days per year23. See the Pendleton County page for rules on land outside Falmouth.

Building a home in Falmouth, KY: the steps, in order

  1. Find the parcel's zone on the city zoning map and check the lot area and setbacks for that district3.
  2. Ask whether public sewer and water reach the lot; if they do, the building must connect5.
  3. If no sewer serves the lot, book an onsite evaluation with the Three Rivers District Health Department before you design the house20.
  4. Apply to the City of Falmouth Planning & Zoning office for a zoning permit before building or grading1. Ask the same office whether a building permit and inspections also apply.
  5. Check floodplain status first; Kentucky requires both a state and a local floodplain permit for development in an identified floodplain24.
  6. Plan the driveway: Falmouth limits access points in the rural, UR and SR zones to between 9 and 20 feet wide25, and a driveway onto a state highway needs a written application to the Department of Highways District Engineer26.

What stays with Pendleton County, and what should you check before buying in Falmouth?

Septic and wells are not city decisions. The Three Rivers District Health Department serves Pendleton County and handles septic evaluations and permits2, and Kentucky requires a certified driller for a water well, with no permit application or fee for the property owner27.

The county's planning and zoning page also lists the City of Falmouth among the areas it serves, so zoning staff may be reached at either the city or the county office28. The county's own permit rules, such as its zoning permit for all new construction, are stated for unincorporated land and do not govern lots inside the city29.

County-level numbers for context: Pendleton County's effective property tax rate is 0.8%30, and its median property tax bill is $1,246 per year31.

Watch-outs

  • Falmouth's city planning page lists its own zoning administrator, while the county planning page says the county provides zoning administration for the City of Falmouth28; confirm with the city office which one issues your zoning permit.
  • We could not confirm Falmouth's rules on building inspections, certificates of occupancy, subdivision, owner-builder exemptions, tiny homes or short-term rentals; ask the City of Falmouth Planning & Zoning office, which handles the city's permit applications17.
  • Development inside a mapped floodplain in Falmouth is regulated under the city flood ordinance32, and Kentucky also requires a state floodplain permit24.
