Which South Dakota counties don't require a building permit?
Eight South Dakota counties do not require a residential building permit in unincorporated areas: Tripp County, Corson County, Jones County, Oglala Lakota County, Ziebach County, Campbell County, Buffalo County and Haakon County.1 Another 11 counties require a permit only in some cases, and 47 require one.23 The no-building-codes county list compares them.
The "limited" label covers different things. Custer County's entry reflects building permits for larger structures, while Todd County, Dewey County, Harding County, Yankton County, Aurora County and Potter County are listed as limited because of the statewide electrical wiring permit.2 Read the individual county page before assuming a limited county has no permit at all.
Does South Dakota have a statewide residential building code?
South Dakota's default 2024 International Building Code standard applies to buildings begun after July 1, 2026 in places with no local building ordinance, but it excludes residential structures, mobile or manufactured homes, and farmsteads with their accessory buildings.16 That exclusion does not waive local zoning or other local requirements.17
The statute's authority to adopt the 2024 International Residential Code is written for municipalities and does not name counties.5 So a county's residential building permit answer rests on that county's own ordinance, and cities inside a county may apply a residential code the county does not.18 One rule applies everywhere: a county, municipality or township may not require a building permit for repair or substantially similar replacement of listed exterior parts of a detached owner-occupied single-family home.18
Which South Dakota counties have no zoning?
South Dakota has 12 counties without county-wide zoning, led by Custer County, Corson County, Fall River County, Charles Mix County, Jones County, Butte County, Oglala Lakota County and Ziebach County.4 Another 50 counties have county zoning.8 We could not confirm the zoning answer for Lyman County, Todd County, Jackson County or Potter County; ask the county auditor, who files county ordinances.918
Seven counties have neither a residential building permit nor county-wide zoning, starting with Corson County, Jones County and Oglala Lakota County.10 Compare the no-zoning list and the no-codes, no-zoning list. County boards may regulate building size, yards and lot coverage by zoning ordinance, so a county with a zoning ordinance can restrict a parcel even without a building permit.19
Who issues septic permits in South Dakota?
The South Dakota Department of Agriculture and Natural Resources (DANR) administers minimum requirements for individual and small on-site wastewater systems, and local governments may impose stricter ones.20 In 52 of the 66 counties we checked, DANR is the septic authority; 8 more are listed as served by a multi-county health district, and in 6 a county office issues septic permits.6 The county offices named are Pennington County's Planning Department, Lawrence County's Planning and Zoning Department and Minnehaha County's Planning Department.6
DANR asks owners to contact it before installing a new on-site system, except a conventional system serving an individual residence.21 Where water or electricity is unavailable, the rules call for vault privies, chemical toilets, incinerator toilets or composting units, and every unconventional system except a vault privy needs plans approved before installation.22 Confirm with the county planning office before you apply, because the answer varies by county.
Do you need an electrical or plumbing permit in South Dakota?
Yes, even where no county building permit exists. An owner who wires their own residence or farmstead needs an approved homeowner permit before starting; the owner exemption waives licensure, not permitting or inspection.11 A state wiring permit costs $20 and is valid for three years, and one is required for service entrances over 60 amperes and when the estimated inspection fee is $30 or more.12
Inspectors need at least 72 hours' notice, a rough-in inspection must come before wiring is covered, and a final inspection is required before occupancy.23 The installer must send the white permit copy to the commission within 15 calendar days after starting.24 Homeowner permits do not cover rental or commercial property.7 Questions go to the state Electrical Commission.25
Plumbing installations outside cities with their own inspection programs need a plumbing inspection; the single-family inspection fee is $110.26
Can you live in an RV or tiny home on your land in South Dakota?
We could not confirm a statewide rule on living in an RV or tiny home on private land, so the answer comes from county zoning.19 Only 5 counties have a reviewed RV answer: Douglas County is temporary-only, with occupancy limited to a short stay unless a special permit is issued, and 4 are limited; no county is listed as allowing RV living.13 The limited answers for Moody County, Brown County and Codington County concern RVs in flood-hazard zones, and Brule County's concerns camping units under its zoning ordinance.13 The other 61 counties are unanswered, not allowed.13
For tiny homes, 3 counties have an answer: Perkins County allows a qualifying tiny home as a single-dwelling unit, while Beadle County and Brule County limit them.14 See the tiny-home list. Ask the county planning office, and DANR about sanitation.20
Where are the best South Dakota counties for a bolthole?
Custer County leads the Bolthole Index at 70 out of 100, with building permits limited to some cases, no county-wide zoning and septic handled through the Custer County Planning and Economic Department.276 Pennington County scores 67 and Lawrence County 62; both require residential building permits, have county zoning and use county septic offices.27 Tripp County scores 58 with no residential building permit, county zoning and state septic authority.27
The median county farmland value is $3,173 per acre, and Oglala Lakota County has the lowest at $871 per acre.28 Those are farmland values, not a quote for a homesite. The median effective property tax rate is 1.1%, and the median county bill is $1,598 a year.15
What should you check about South Dakota water, wells and access?
South Dakota exempts domestic water use up to 25,920 gallons per day (25 gpm or less) and gives it preference over permitted uses.29 Ask the DANR Water Rights Program whether your use needs a water-right permit before you drill; when one is required, approval must come before drilling unless the chief engineer permits a test well.3031
The Tulare aquifer regimes covering Beadle County, Hand County and Spink County are fully appropriated and rated over-appropriated or declining.29 A new driveway onto a state highway needs South Dakota DOT permission, and construction cannot start until the access permit is issued.32 Splitting land into parcels describable only by metes and bounds generally requires a recorded plat before a transfer can be recorded.33
Watch-outs
- County counts describe unincorporated land; cities may apply their own residential building code, so confirm the parcel's jurisdiction.5
- No residential building permit does not remove state electrical permitting and inspection requirements.11
- Local electrical inspection systems may have their own procedures, inspection fees and regulations.12
- Floodplain development permits apply in participating communities, incorporated or unincorporated.34
- We could not confirm county-wide zoning in 4 counties; ask the county auditor before you buy.9
