Do you need a building permit in Box Elder County, Utah?

New homes in unincorporated Box Elder County require a building permit; construction, alterations, moving structures and land-use changes also require valid permits unless an exemption applies115. Adopted codes include the 2024 International Residential Code, and residential work receives staged inspections before being covered1617. Sole owners building for personal use must file the owner-builder form, have no other residential project that year and have built no more than 3 residential structures within the form’s lookback period; paid helpers must meet the form’s licensing or employment conditions10. Agricultural structures used solely for agriculture, without human occupancy, may qualify for exemption, but plumbing, electrical and mechanical permits may still apply18. File the agricultural form and setback site plan; county-approved subdivision parcels under 2 contiguous acres generally do not qualify unless another exemption applies, and converting an exempt barn to residential use requires county review1819.

Who is the Box Elder County building department, and how do you reach it?

Box Elder County's Building Permits/Inspections office is at 1 S Main Street, Room 19, Brigham City, UT 84302, phone 435-734-2634, and the Chief Building Official can be reached at cillum@boxeldercountyut.gov20. Fees follow the state ICC structure, with a 1% state fee; dwelling plan review is 50% of the permit fee, and the dwelling deposit is $1,70023. Community Development/Planning & Zoning is at 1 S Main Street, Room 34, Brigham City, UT 84302, phone 435-734-335424. The county rules here apply to unincorporated land; Honeyville issues its own building permits, while Bear River Health Department still issues off-sewer septic permits inside Honeyville152526.

Does Box Elder County have zoning?

Unincorporated Box Elder County has mapped zoning and significant unzoned areas; confirm parcel status with Planning & Zoning424. Tremonton and Honeyville set their own zoning; Bear River Health Department handles off-sewer septic permits272878.

Minimum main-use lots are MU-160: 160 acres; MU-80: 80; MU-40: 40; A-20: 20; A-1/2: 0.5; RR-10: 10; RR-5: 5; RR-2: 2; RR-1: 1 acre2930. These districts require 30-foot front yards, or 63 feet from the road centerline where the right-of-way is less than 66 feet31. Main-building side yards are 60 feet in MU districts, A-20 and RR-10; 20 feet in RR-5 and RR-2; 15 feet in A-1/2 and RR-132. Nonagricultural buildings have a maximum height of 35 feet or 2.5 stories33.

RR-20 and R-1-20 require 20,000 square feet, allow 40% coverage and require 30-foot front and rear yards343536. Existing R-1-8 dwelling lots require 8,000 square feet; the district is unavailable for rezoning37. R-1-8 main-building yards are 30 feet front, 25 feet rear and 8 feet each side, with combined side yards of at least 18 feet38.

How do septic permits work in Box Elder County?

Septic permits in Box Elder County go through the Bear River Health Department67. South-county applications go through the Brigham office; north-county applications go through the Tremonton office7. Both offices use (435) 792-65003940. A septic permit is required before constructing, altering or repairing an onsite system where sewer lines are unavailable3. Subdivision development also needs a septic-feasibility letter unless sanitary sewer serves it3. Published fees are $840 for a conventional system, $1,040 for a commercial system and $350 for an alteration; repair permits have no fee8. Only 10.5% of the county's soils are rated “not limited” for a conventional drain field, so obtain a site evaluation before buying and allow for an alternative design41. We could not confirm a routine inspection interval for existing residential systems; ask the Bear River Health Department about the parcel.

Can you live in an RV or tiny home on your land in Box Elder County?

Unincorporated Box Elder County prohibits permanent RV living except in designated, permitted mobile-home or RV parks and agricultural workforce housing9. An issued building permit for a single-family dwelling allows on-site RV residence for up to 365 days or until the certificate of occupancy, whichever comes first9. Recreational camping is limited to 14 consecutive days and 90 total days per calendar year, with dumping only at approved facilities42.

Agritourism RV facilities have separate rules: an administrative conditional-use permit, site-plan review and at least 5 acres in unzoned areas or zones with density of 5 acres or greater43. Agritourism RV spaces must meet underlying-zone main-building setbacks, and the facility needs an annual county business license; visitor septic and water connections are prohibited4443.

A detached ADU needs an administrative conditional-use permit in a zone allowing single-family residences and septic-feasibility approval; RVs and temporary structures do not qualify11. We could not confirm separate tiny-home or manufactured-home occupancy rules; ask Planning & Zoning how the proposed dwelling is classified24. County dwellings must be at least 20 feet wide at the narrowest main-floor point for at least 20 feet, excluding the garage45.

Building a home in Box Elder County: the steps, in order

  1. Ask Community Development/Planning & Zoning to check the Official Zoning Map and identify the parcel's mapped district or unzoned status before design begins4624.
  1. Secure water and wastewater. A private well requires a valid Utah water right and an approved Start Card, while off-sewer development requires Bear River Health Department septic review4748.
  1. Confirm driveway access; county rules limit residential driveway number and width, and a state-highway connection requires a UDOT conditional access permit4950.
  1. Submit the complete home-permit package to Building Permits/Inspections and file the owner-builder certification if applicable215120.
  1. Allow 7 to 10 business days after all documents arrive, then schedule each inspection at least 24 hours ahead and leave work uncovered until approval2122.
  1. Obtain the certificate of occupancy before using the home; occupying a covered building without one is unlawful52.

What to check before you buy land in Box Elder County

For subdivision land, utility availability can determine whether off-grid plans work: sewer connection is required within 300 feet where capacity exists, and a willing culinary water company with lines within 1,000 feet must supply the lot53. A private well requires a valid Utah water right and approved Start Card; shallow wells are regulated too47. In the Agricultural Heritage Zone, residential lots generally require 20,000 square feet unless on a well, with base density of 5 acres for a culinary tap and paved road or 10 acres for a well or gravel road54.

Splitting land requires county subdivision review, including a surveyor’s plat, utility will-serve letters, a title report and septic-feasibility documentation unless sewer serves the development553. The effective property-tax rate is about 0.5%, with a median annual bill near $1,8285657. We could not confirm floodplain-development permit triggers or short-term-rental rules; ask Planning & Zoning before committing24.

Watch-outs

  • Box Elder County’s unzoned land still falls under general county regulations, including building-permit and occupancy requirements581552.
  • We could not confirm the R-1-8 building-height limit; ask Planning & Zoning to resolve the applicable standard before designing5924.
  • General rules apply on unzoned land: residential accessory buildings have a 35-foot height limit, except agricultural buildings, and must meet applicable district setbacks5860.
  • We could not confirm when Box Elder County requires a floodplain-development permit or what rules govern short-term rentals; verify both with Community Development/Planning & Zoning24.
