Do you need a building permit in Kane County, Utah?

Kane County expressly requires building permits for water-heater replacement, meter-base installation, solar-panel installation, electrical-panel replacement, furnace installation or replacement, and a non-habitable accessory structure of 200 square feet with a primary residence when it has no electrical or plumbing11. For projects outside that list, call the Building Department at 435-644-498512. Kane County has adopted the 2021 building, residential, plumbing, mechanical and fire codes and the 2020 electrical code13. A structure used solely for agriculture and not for human occupancy may qualify for a state construction-code exemption, although plumbing, electrical or mechanical work may still require building permits and tract-specific exceptions apply14. Kane County's agricultural density exemption excludes qualifying structures from density calculations; it does not waive all zoning, building or septic requirements15.

Who is the Kane County building department, and how do you reach it?

The Kane County Building Department is at 76 North Main Street, Kanab, UT 84741, and its permit-question phone number is 435-644-498512. Building applications are online because the county no longer accepts paper applications, and applicants use their online account to request inspections or check permit status12. Applications that fail the listed Utah statutory submission requirements will be rejected16. For work subject to Utah's construction code, the agency with jurisdiction is responsible for inspections and code enforcement; after requesting an inspection, an applicant may use an approved third-party inspection firm for the originally requested scope17. We could not confirm a complete Kane County building-permit fee schedule or project-by-project inspection sequence; ask the Building Department for both before starting work12.

Does Kane County have zoning in unincorporated areas?

Kane County zoning applies to unincorporated land; Big Water sets its own zoning inside town limits23. Septic approval in Big Water stays with Southwest Utah Public Health Department18. Verify current parcel zoning with the Recorder's Office or Land Use Authority19.

Minimum lots are 1 acre in R-1, 2 acres in R-2 and 5 acres in R-5; all have 30-foot front and 10-foot side and rear setbacks2021. Kane County accepts no new R-½ lots; that zone remains for administration of existing lots20. RURAL 10 and RURAL 40 require 10-acre and 40-acre lots respectively, with 30-foot setbacks on every side2223. MR requires at least 1 acre, a 30-foot front setback, 20-foot side and rear setbacks, and building coverage no greater than 30%242526.

Internal accessory dwelling units are permitted within primary homes in county residential zones, subject to building, health, septic and zoning requirements9. Land-use application fees include $400 for a zone change and $1,000 for a subdivision including a PUD, plus County Engineer review costs27.

How do septic permits work in Kane County?

Southwest Utah Public Health Department handles onsite wastewater permitting for Kane County and reviews plans, issues permits, conducts inspections and keeps septic records528. Call the Kane County Environmental Health contact at (435) 296-5477 ext. 322628. A permit and approved design are required before installing, replacing or modifying a septic system, and soil and percolation testing must be completed by a Utah-certified onsite professional before design or installation29. The department must inspect a new or modified system before backfilling, and project information must remain on site30. Only 9.5% of Kane County soils avoid severe limitations for a conventional drain field, so establish feasibility before fixing a house location or purchase budget10. An approved onsite system can serve off-grid land where public sewer is not used, but alternative sanitation technologies are not automatically authorized31.

Can you live in an RV or tiny home on your land in Kane County?

Occupied RVs in unincorporated Kane County residential zones are generally limited to an RV park, manufactured or mobile-home park, designated camping area, or an exception allowed by the county code6. Seasonal use allows no more than 2 RVs for no more than 6 consecutive months in a calendar year, without rent, subject to setbacks, culinary water, approved septic, electrical safety, licensing and storage requirements6. A temporary-use permit can authorize longer occupancy or more RVs under stated conditions, and living in an RV while building requires the building permit before the temporary-use permit6. Kane County treats a tiny home on a trailer as an RV7. In R-1/2, R-1, R-2 and R-5 zones, one short-term rental is permitted per lot or parcel, but it needs state registration, tax IDs and a county business license32. Permanent-foundation tiny-home occupancy remains unconfirmed; ask the Land Use Authority how the parcel's zone treats it33.

How do you build a home in Kane County, step by step?

  1. Confirm that the parcel is unincorporated, verify its zoning and legal parcel status with the Kane County Land Use Authority, and resolve any improper division before expecting a building permit233.
  2. If dividing agricultural land, plan around a 10-acre lot, with a narrow allowance down to 9.5 acres for specified survey conditions and with county approval34.
  3. Confirm legal access; a new connection or changed access intensity along a state highway requires a UDOT conditional access permit35.
  4. Secure water and septic approval before design: a private well needs a valid water right and Start Card, while septic needs certified testing and an approved permit3629.
  5. Submit the building application online because paper applications are not accepted12.
  6. File the Owner/Builder Certification for personal, non-commercial use; new residential construction requires sole ownership, the only residential structure built that year and compliance with the certification’s prior-construction limit8. Use licensed contractors or labor allowed by the certification; the licensing exemption does not waive building permits or inspections37.
  7. Request building inspections through the permit account, and keep a new or modified septic system uncovered until the health department inspects it1230.

What should you check before buying land in Kane County?

Kane County can withhold building permits from improperly divided land; covered subdivisions also need required improvements installed and accepted by the County Engineer238. Test septic feasibility and confirm water rights before committing to a site: only 9.5% of county soils avoid severe conventional drain-field limitations, and a private well needs a valid water right1036.

Agricultural-zone parcels of 160 acres or smaller allow at most 2 single-family dwellings and 7 non-exempt structures, with non-exempt coverage capped at 40%; additional density needs a zone change or PUD3940. Qualifying agricultural structures are excluded from density calculations41. Agricultural and Rural-zone animal or fowl enclosures must be at least 50 feet from an adjacent lot's dwelling; reduced accessory setbacks carry placement and corner-lot conditions42.

Residential single-lot PUDs cap building coverage at 50% of net acreage and height at 35 feet unless a taller building is approved through the zone change4344. PUD front-setback wording is inconsistent; ask the Land Use Authority to resolve it before drawing a site plan4533. County-road driveway and floodplain-development requirements remain unconfirmed; ask the Building Department who reviews them12.

Watch-outs

  • Kane County's published project list is not comprehensive; call the Building Department at 435-644-4985 if your project is not expressly listed112.
  • A tiny home on a trailer is regulated as an RV, while permanent-foundation tiny-home occupancy and a countywide minimum dwelling size remain unconfirmed; ask the Land Use Authority before buying733.
  • A building permit may be withheld for a structure on improperly divided land until the parcel complies with current land-use and subdivision ordinances2.
  • Kane County's residential PUD ordinance gives conflicting front-setback figures; confirm the required setback with the Land Use Authority before designing4533.
