Which Texas counties don't require a building permit?

Texas has 164 counties without a residential building permit requirement, 77 with requirements limited to particular cases, and 13 with a building permit requirement.167 Start with Cherokee County, Sabine County and Angelina County, which fall in the no-residential-building-permit group.1 Browse the Texas no-building-codes list for the full comparison.1

A missing building permit requirement does not establish an exemption from construction standards: Texas county residential-code authority can apply without authorizing prior approval of new residential construction.13 Texas also has mandatory codes specifically for industrialized housing and buildings; that program is not a universal code adoption for all site-built construction.14 Owner-performed electrical work has a state licensing exemption only for a dwelling the owner owns and resides in, and local building permits or inspections are not waived.11

Which Texas counties have no zoning?

Texas has 246 counties without countywide zoning, while 8 counties have zoning in applicable areas.28 Cherokee County, Sabine County and Angelina County are among the counties without countywide zoning.2 Texas county zoning authority is geographically or subject-matter limited, rather than a general statewide grant of county zoning power.15

For buyers seeking both conditions, 158 Texas counties have neither a residential building permit requirement nor countywide zoning.9 Use the no-zoning list and the no-building-codes and no-zoning list to narrow your search.29 Septic approval remains a separate question, because Texas generally requires an OSSF permit and approved plan even where a county does not require a residential building permit.161
